LETTER TO THE AG'S OFFICE ON MCC TV3

Dear Office of the Attorney General:

Your office requested that I keep you apprised of any new information on Medford Community Cablevision, Inc.  There is a new development that you should be aware of.

After I obtained  REDACTED REDACTED REDACTED REDACTED REDACTED REDACTED in addition to the document signed in Superior Court by a former station manager to stay away from my home and the gas station next door, one of the alleged architects of these nuisances exacted on me for my investigation as a journalist into the bizarre behavior of Medford Community Cablevision, Inc. decided that he, Harvey A. Alberg, would retaliate by filing an harassment protection order against this journalist.  

I prevailed over the malicious abuse of process.

What I find deeply troubling is that the city solicitor was engaging in conversation with both Arthur Alan Deluca and Harvey Alberg at Somerville Court for some length of time. It was clearly not a "hi and goodbye," but they were deeply involved in conversation, from what I could see, in the hallways of Somerville District Court on September 1, 2016.

Before I offer the new evidence I am requesting that Mayor Stephanie Muccini-Burke recuse the city solicitor, Mark E. Rumley, from further investigating the board of directors he was appointed to, and that outside counsel be brought in to protect Medford cable TV subscribers from any further
damage.

Mayor Stephanie Muccini-Burke is so negligent that she doesn't even have a Cable TV Advisory Commission in our city that I am aware of.  I am CC:ing Robert E. Skerry, a former fraud investigator, and Richard Giovino, who served on Mayor McGlynn's alleged commission. The former Mayor, McGlynn, had an interesting way of utilizing boards and commissions: they spend time and resources giving him advice, McGlynn seemingly putting his own ideas into motion prior to his parking commission or cable TV commission reporting to him, their advice purportedly ignored.

This is important to have on public record.  Medford cable TV subscribers are cheated repeatedly. 

Heidi Riccio from the Vocational/Technical school advising the Medford School Committee that the new TV station would be open in September of 2016 at the high school (against the advice of  Allison Goldsberry, Rev. Chip Hines and Fred Laskey - the tribunal that decided otherwise - and why was a priest and a member of the MWRA on the cable tribunal when Medford has residents who have forgotten more about cable TV than those individuals, respectfully said, will ever learn?)


Then the Mayor - Mrs. Burke - clueless as usual, claims it will be open in October of 2016.  Well, it is now November 1 and last month the Superintendent Roy Belson gave me a tour of the empty room and said it would be open in January of 2017.  So much for transparency and public access television PAID FOR by cable tv subscribers being able to operate in this city.

Now - to the matter of Medford Community Cablevision, Inc. clerk Harvey A. Alberg.

Judge Fitzgerald in Malden District Court on or about October 13, 2016 gave me permission to file for a criminal harassment claim against Mr. Alberg.  I am awaiting the return of my attorney to discuss the matter as he has a family emergency and is unavailable.   I have a claim of an assault against the President of Medford Community Cablevision, Inc. who, in a court of law, went out of his way to come over to my person, while I was behind the velvet rope, intentionally and maliciously walking over to me and stomping on my right foot.

Somerville Court advised me last week that they have moved the case to another court.
The TV3 "president," who allegedly appointed himself by using former board members Susan Crowley (in the CC above), Tim Pilleri (who was in Los Angeles purportedly at the time,) former postal employee Brian Mahoney and former MCC Vice President Paul Gerety as CURRENT board members, purportedly to seize power at the 501c3.  

When I brought the Brian Mahoney issue to the attention of the City Solicitor, Solicitor Rumley found the information on Gerety, Crowley and Tim Pilleri, all in the Rumley Report given to Mayor McGlynn but - surprisingly - missing the information on Brian Mahoney, the key board member who acknowledged to me that he wasn't on the board when Pilleri alleged, under the pains and penalties of perjury, that Mahoney was.

So why didn't city hall immediately pull the agreement with MCC, and why didn't the AG's office press to remove the 501c3 status from a board of directors which: a)kept limited meeting minutes -sometimes none at all,  b)had a new Vice President, Ron Delucia, smirking that he was "only guilty of sloppy bookkeeping" to the city council of Medford - no financial records of value, and c)the highly suspicious board found abusing the court system with 3 instances of anti-SLAPP violations and terrorizing the community - suing the city, litigating against this writer and the late Pat Fiorello, all with cable TV subscriber funds.

THE AFFIDAVIT OF HARVEY ALBERG
Which brings us to the new evidence

1)On page 6 of the October 7, 2016 Affidavit of Harvey Alberg "Signed under the penalty of perjury" is this statement:

18. (Line 7) "This posting was published long after we were cleared of any wrongdoing at the cable television station and Mr. Viglione knew it."

---What Mr. Viglione knew was in responses from the Attorney General's office information was withheld because it might "impede law enforcement."

How does information not given to the public as it may "impede law enforcement" become some declaration of being "cleared of any wrongdoing"  ???

Mr. Alberg has been fast and loose with the truth regarding toxic mold, the status of volunteer producers cheated by Alberg, Ron Delucia, Frank Pilleri and their board  that was forced out by Mayor Michael J. McGlynn, and other rants including but not limited to a false address of 625 High Street that Alberg has used for years on the corporate document rife with a pattern of false information:  former board member Steven Marra proclaiming that his home address was the corporate address of 5 High Street, Arthur Deluca falsely publishing the name Delucca (sic) ostensibly so that it could not be found in corporate search engines, etc. etc. etc.   "Cleared of any wrongdoing"  ? 

But the big question is, this is an affidavit filed with Malden District Court under the pains and penalties of perjury.

When asked in a court of law (Cambridge District Court" who was paying for the multiple lawsuits, Francis R. Pilleri, Jr. - the alleged "president" of the station - the self-appointed president - whispered "we did."  When asked again to give an HONEST answer (the "we did" implied they were using their own personal monies, not cable TV subscriber monies) Pilleri had to be honest and he whispered "MCC."   Medford Community Cablevision, Inc. monies were used to sue the city (the station lost;) to litigate the Dawn Natalia case (Natalia, disgraced, lost;) monies used in two other cases found to have violated the anti-SLAPP statute three times.

Cleared of any wrongdoing?    I demand that the Medford Police Department, the Malden Police Department and the Office of the Attorney General, as well as Malden District Court, study this affidavit and - if necessary - press charges against the individual who filed it on October 7.

2)On page 8 of the October 7, 2016 Affidavit of Harvey Alberg, signed under the pains and penalties of perjury, Mr. Alberg declares:

22:(line 3) "I resigned from the Board of Directors. I resigned because I had neighter the time nor the inclination to defend myself..."

How can this be if his name is still on the Corporate website?   
How can this be if in the October 1, 2013 document from Frank Pilleri to the City Solicitor that something would "go away" if the Mayor "cooperated"

a)What would "go away," the alleged pending charges of racism by the station with an allegation that the "n" word was used and the minority woman's life allegedly threatened?

b)Financial matters?

This document, discovered via a public records request and received in January of 2014
hardly looks like people were "cleared" of any wrongdoing?

How could a board member "resign" - as Alberg claims in an affidavit signed under the pains and penalties of perjury, if the courts and the AG's office have not dissolved the corporation? 

c)On October 24, 2016 PM I received an e mail from the public charities division that, still, information could not be divulged as it could impede law enforcement.

d)On October 17, at 1:22 pm, the City Solicitor, Mark E. Rumley, stated "The City of Medford is not in possession of any records that are responsive to your public records request of Saturday, October 16, 2016."

My public records request was specifically written in regards to Harvey Alberg's claims in his affidavit of October 7, 2016, signed under the pains and penalties of perjury.  

Alberg, under oath on October 31, 2016, told the judge an outright lie.  He claimed that he approached me in October of 2006 (which he did, when Paul A. Camuso, then a city councilor, left the council while in session to chase after me,) Alberg lying to the judge that he wanted to put my show on the air.  Mr. Alberg was one of the individuals keeping my show OFF the air.  Alberg said to me "You hurt a lot of people" in front of Camuso when they all ganged up on me, Dawn Natalia and the TV3 cronies.  There is a police report I filed ON Paul A. Camuso that night which clearly contradicts Mr. Alberg's statement to the judge ten years later, under oath.  They were harassing me, not helping me, and Camuso - as well as Alberg - have a long history of ugly behavior aimed at critics of TV3.

I demand the AG's office get the court transcripts of 2 PM October 31, 2016 and see if Alberg's statements to the judge are correct.

The AG's office must keep in mind that in Cambridge District Court, Judge Timothy Gailey noted in his findings regarding Frank Pilleri's filing former board members with the office of the Attorney General as if they were current board members: "This assertion of perjury was not proved to have been false."

Frank Pilleri couldn't prove the assertion of perjury to be false in a court of law.  Frankie Pilleri had his day in court and could NOT prove that the assertion of perjury to be false.

What is the conclusion of the Attorney General's office in regards to Pilleri's filing of a non-profit corporation with allegedly false names on the board of directors.  Should not the non-profit status of the station have been pulled back in 2005?  Why were the authorities, including the authorities at Medford City Hall, so negligent?

The Affidavit of Harvey Alberg

In Meeting Minutes of Medford Community Cablevision, Inc. dated October 18, 2006,
Attorney David P. Skerry, first President of TV3 and by 2006 the station's counsel
said this:


xi. Skerry confirmed that Joe Viglione resigned his
membership with TV3 Medford on his own accord and has
not been a member since

On Page 1 of Harvey Alberg's Affidavit is an obvious lie, under the pains and penalties of perjury

4. "During my time there Mr. Viglione was a writer and producer of cable programming. Eventually his relationship with the station soured, and he was banned for multiple violations of policies and procedures."

This was said to the court to put the victim, Viglione, in a bad light.  Mr. Viglione resigned when the station was on the verge of shutting down in 2003 and 2004.  Resigned. It is there in the meeting minutes as stated by Attorney David P. Skerry.

I demand that the division of Public Charities investigate these statements. I will be sending a copy of the Affidavit via U.S. Mail along with a copy of this correspondence.

With all this being stated, I demand that the Office of the Attorney General and possibly the Malden Police Department, the Medford Police Department and Malden District Court look at the affidavit of Harvey Alberg dated October 7, 2016 AND his testimony to the judge on October 31, 2016, and if the police and / or AG's office finds that the board member of Medford Community Cablevision, Inc. did not honestly testify, that charges be pressed against Harvey Alberg.

As Judge Fitzgerald has given me the green light to file for an order of protection against Alberg, these documents will be utilized should I proceed with my action for protection against Alberg.
I will be talking to multiple attorneys about this case, but it is the obligation of the office of public charities to look into this valuable information regarding the conduct of Medford Community Cablevision, Inc.
