Full Editorial by Joe Viglione on Freedom of the Press Squelched in the City of Medford

The goal is simple: to have an access television station with no restrictions on free speech and freedom of the press as granted by the lawsuit Demarest vs Athol/Orange, to hold Medford accountable for failure to abide by the Public Accommodations law.

MARK RUMLEY DOES NOT WANT YOU TO READ THIS, OR TO SUE THE CITY USING THIS PRECEDENT:
The court's decision "opens up more doors to the common citizen to be granted the same rights as a professional journalist," said Patricia Demarest, a plaintiff in the case and co-producer of "Think Tank 2000."

Demarest's attorney, Bill Newman of the American Civil Liberties Union, agreed, saying the ruling "empowers citizens as publishers to gather information."

An Editorial by Joe Viglione on Mark Rumley's squelching of our civil rights granted by the First Amendment to the U.S. Constitution

Where is our access television for all?
The Public Accommodation law and the First Amendment are anathema to Mark E. Rumley, Medford's long-time city solicitor and arbiter of taste.  It's disgusting when you think about it.

topic: RACISM AT TV3, which eventually brought the station down
In early 2003 I met with Mr. Rumley and Diane McLeod, who had Neil Osborne's job as Human Rights Commissioner, regarding then station manager Steve Marra's atrocious abuse of homosexuals and African Americans, laughing loudly that an "N-word" is an "N-word," "A fag is a fag, a spade is a spade."    Marra would force his skewed religious beliefs on members, resulting in another employee, Marc LeMay, stating to me "I'd like to tell Steve Marra what I think of his "born again Christian" religion" (paraphrased; noting what we all knew, that Marra was a hypocrite forcing his religion on members, especially with the gross line "I can sin because I am saved" which is the complete opposite of what Jesus taught when he said in John 8:11  "Go. From now on sin no more."  (The Lord was probably talking to married TV3 employee Von Rommel Fernandes making a joke about me potentially having sex with him.  It was a sexual free for all at MCC TV3, which is why Pat Gordon and Jay Campbell and crew don't want to talk about it)

Nowhere in the Bible does it say "You can sin for you are saved."  But Mr. Marra bullied people, and was reported to Mark Rumley in early of 2003 by Joe Viglione, and it took ten years of my hard work and honest efforts to shut down the infestation known as Medford Community Cablevision, Inc. because of, you guessed it, "Hate Speech" that Rumley failed to quell, even as a BOARD MEMBER allegedly WITH Marra on the failed 501c3's board of directors.  A board member and a powerful city solicitor took ten years to address the blatant racism that I brought to his attention - and he and the Medford police made me do the heavy lifting.

Mayor orders Medford police investigation into allegations of hate ...
Jul 10, 2013 - The Medford City Council this afternoon is receiving the following letter from Mayor ... an incident of hate speech while she was a member at TV3.

Racism and gay bashing continued with Mark Rumley's knowledge when Mr. Rumley joked to me about his fellow board members "they are equal opportunity slappers," an admission of the guilt of the board that Rumley was on, but no solution, no fixing of the problem, and for a hideous reason: Rumley's good friend and boss, Michael J. McGlynn, loathes free speech and access television.

And Ms.Diane McLeod, on the Human Rights Commission with useless chief Leo A. Sacco Jr.,  had some cockamamie excuse for not doing her job, that she was "educational" leaving it up to the overworked MCAD to do what the city should have as its own investigative department.

Now you've got a "new" station manager claiming he doesn't want to know about the racist past - with four individuals from that racist past infecting the "new" station, Paul Gerety, the hateful Steve Bertorelli, elder basher who lied to the police repeatedly - Arthur Alan Deluca and Mark Rumley himself - four individuals who should be as far away from the Medford access station as humanly possible.

For Pat Gordon, and Yvette Wilks, Jay Campbell and Gabby Follett-Sumney to all have the same talking point - that they are "moving forward" and do not want to know about the racist past, with four members of the TV station shut down for racism in their midst, is equally disgusting.

OFFICE OF THE MAYOR, JULY 10, 2013 *(only 5 years ago)
Among the acts that most significantly diminish the rights of each one of us to life, liberty and the pursuit of happiness are discrimination and hateful words or conduct. I join with the council in a unified denouncement of any such behavior.

Accordingly I have requested of Police Chief [Leo] Sacco that the Medford Police Department commence a full investigation into this matter immediately. The investigation began this afternoon.

At its conclusion I will inform you of the results of this investigation.

That's from Mayor McGlynn.  As usual, there were no "results" of this investigation.  Of course not.
Rumley later did another "investigation" into his fellow board members, extended their deadline, and then ran like a rat so as not to incriminate himself and his colleagues, allegedly, and threw the hot potato at the Attorney General's office, which he should have done in the first place instead of getting cable TV subscribers' hopes up that the missing monies would be recovered

Of course when city officials like the chief of police, city clerk, city solicitor, mayor, school superintendent etc. are the ones being investigated, your ability to "petition the Government for a redress of grievances" goes promptly into the toilet.

In Medford  they "squelch" freedom of the press, they allegedly "buy off" bad criticisms in the Medford Transcript with legal notices or whatever else the weekly paper gets in revenues from city hall, paid for by the taxpayers that are being denied transparency.

(I asked Nell Coakley "Who is she" in regards to her source at city hall for stories. She smiled "Who said it's a she?" which leads me to believe her source, of course, was and possibly still is Mayor Michael J. McGlynn)

MILLIONAIRE SAYS TO JOE V: Why are they after you? You're small potatoes!"  Why indeed!
When someone protests as much as Rumley does, and gets petty and vindictive with a blogger, logic tells you that whatever they are doing, it is so bad, so ugly, much worse than what we already know, that it cries out for a full investigation, an outside audit, and to hold those accountable - be it a rogue police chief whose son never got a breathalyzer ...or an arrest...or a city lawyer allegedly moonlighting on Thursdays at Somerville District Court collecting bills - allegedly - for credit card companies instead of serving the public paying him at Medford City Hall...that's when he's not using a taxpayer funded e mail for the Immaculate Conception church website.  A practice that stopped after my letter of complaint.

The millionaire was right.  Why go after a "small potatoes" guy with a blog?  Because they are terrified we will find something out!
Let's look at the U.S. Constitution, a quote from Mr. Rumley to a retired judge, and his "Linked in" to get a clue as to why Medford residents are DENIED full and open access to the public access TV station

Amendment 1
Constitution of United States of America 1789 (rev. 1992)

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Summary

In my position as Chief legal counsel to the City my fundamental tasks are to be accurate in legal analysis, able in argument and clear in rendering opinions. It is my hope that I tend to these tasks diligently and with conscience as my guide.

Your highness, Mr. Rumley, your magnificence, you have failed because of your deceptions, forked tongue and mean spirit.

17 years is way too long for a city solicitor who is duplicitous and who DENIES civil rights to the residents paying his hefty salary.
I have called for Term Limits in our city; the rotten fruit is destroying Medford from the inside.  Rumley must be removed and go the way of Ed Finn, Superintendent Belson, and Chief Sacco - out the door, out to pasture, as far the hell away from Medford as humanly possible, or our city is going to die.

Rather than encourage free expression Rumley finds lame excuses to NOT have the access TV computers at the Medford Public Library.
See Rumley protest too much on this in the pages of the Medford Transcript on the library and access TV station.

As everyone knows, the integration of the library and public access television helps both entities to flourish.  In Medford you have two unethical mayors in Muccini-Burke and McGlynn who want free expression to stagnate.  It benefits them, not the public, though they are hired to be "public servants," they are self-absorbed megalomaniacs allowing a little power to go to their heads.

And they will screw you if you dare speak up about the inconsistencies, hypocrisy, lies (free parking for seniors on the campaign trail, Stephanie Burke screwing you -- after she stole the election -  if you are over 65 with a Twenty-Five Dollar fee that is hardly FREE to people on limited incomes like many seniors!)

She lied. Stephanie Muccini-Burke lied on the campaign trail.  And that liar is the "issuing authority" on Cable TV matters who didn't allow candidates on the air when the station was up and running in September of 2017, yet she, Muccini-Burke, used the station like her own personal prostitute - for her own pleasure, not yours, ratepayer of extremely high cable TV fees.
City Solicitor Mark E. Rumley / Medford Daily Mercury on or about Nov. 16, 2008 (quoted from the 2nd Judge Jackson-Thompson hearing) saying: “The one sentiment that I have heard that I take great exception to is that the city is trying to limit speech,” said Rumley. “The notion the city would censor or squelch free speech is baseless and as city solicitor I would find any such effort repugnant.”

All Mark Rumley does is concoct ways to stop freedom of the press and free speech.  He has threatened to sue me, he has thrown rocks at me from witness stands in Cambridge Court, Somerville Court, Middlesex Superior Court, he has given legal advice to his late brother's best friend, an attorney that I had thrown off of two cases when Rumley was under subpoena from me, not his brother's best friend, Rumley has written to one of my lawyers to get away from me, it is sick, a totally sick human being who stood by when Ed Finn assaulted me, claimed it never happened, then allowed a case to go forward against Finn's victim by not intervening and say "it never happened."

So when you read Mark Rumley's Linked In and his responsibilities and see the Rumley does the opposite of what he is paid to do, violating his oath of office and possibly his oath as a lawyer, you can vomit and understand that you are being ripped off royally.

When did Rumley EVER sponsor shows for the under-privileged in Medford?

A friend of mine is a person with a disability; he's currently undergoing cancer treatment.  He went to the mayor and Mr. Rumley complaining about abuse at the old TV3.  They allegedly put some musical sideman to Tina Turner, not a star, just some random sideman, on the air over another member, a member with a disability.

Allegedly, Rumley and the mayor, McGlynn, were incredulous that he didn't want to go back to his abusers and do a TV show.

This producer invited the sports host to go to a convention at the Hynes Auditorium where I taped him interviewing Larry Lucchino.
Bashed around by family members, bashed around by the city and the access TV station, where was Mr. Rumley to show some charity to a good person who just wanted to interview sports personalities?  Negligent, that was what Rumley did for a disabled person.

Access TV should be about new friendships and working together as a team.  In Somerville, Winchester, Malden, Melrose, you have petty individuals looking at their paycheck and not the facilitation of programming.

Pat Gordon is from Malden where one of the board of directors was found by a court of law to be stalking an access TV producer.
Mark Rumley went on the witness stand to attack the victim.  Mark Rumley didn't go back to work at city hall when the judge dismissed him after my OBJECTION to Rumley's dirty mouth, Sept 1, 2016.  Rumley stuck around and spent time with members of Medford Community Cablevision, Inc. who Rumley was supposed to be investigating - Rumley's fellow board members that he chose to investigate, give an extension to, and drop the investigation. A huge conflict of interest that was detrimental to the city and - I believe - a huge violation of the duties of the chief lawyer in the city of Medford.

Public Accommodations to the access station are stifled by Rumley, Gordon, Wilks, Campbell (who wants to do a real estate infomercial he told me at a cable advisory meeting, not in so many words, but enough for us to piece it together, rather than put my show on the air, the Chair of the Cable Advisory Board is more interested in his own infomercial rather than putting my show on the air, which Paul Gerety promised to do, and reneged on that promise - no surprise)

Pat Gordon said he reached out to producers in the Medford Transcript.  Certainly not the sports host I referenced, a lighting expert, a photographer who is a good friend of McGlynn's and certainly not me.  What producers, Mr. Gordon?  Paul Gerety, Art Deluca, Steve Bertorelli and Mark Rumley from TV3?  Those the "producers" you are referencing?    Rumley requested that I make two copies of The Chumley Report for himself and Judge Jackson-Thompson. It's all about Mark Rumley, isn't it?  He didn't pay me for my fuel to Malden TV, my time and "infinite patience" - to quote the drag queen in Tom Cruise's film Risky Business - my DVDs that Ron Cox in Malden dubbed for me.  Nope.  It's all about Mark Rumley wanting HIS DVD, not yours.

Speech is limited in Medford by the 17 year city solicitor who ignores the law and denies the residents that pay his enormous and unwarranted salary Not when the solicitor is at Somerville Court moonlighting or in Somerville court sticking around and watching a pro se victim get some relief from 17 months of harassment by a board member of Malden Access TV.

Rumley tried to separate me from my lawyer, helped his brother's best friend get back on a case after I had the dullard removed for what the judge called being "conflicted" (sound familiar? - Rumley helped a man a judge deemed "conflicted" to get about 100k of public access monies by beating up on the late Pat Fiorello and me!, two producers,) threw rocks at me from the witness stand, used my research in his Rumley report promising to credit me and failing to do so (how do you think he found out about the fraudulent abuse of former board members?  Brian Mahoney verified that he was no longer a board member, Rumley took the information, contacted other ex board members, failed to credit me and left Mahoney OFF of the Rumley report thinking that by not putting in the lead information, he wasn't allegedly plagiarizing my hard work and honest efforts.)

THAT is what your solicitor is all about.  KEEPING YOU OFF THE TV STATION because the Solicitor has many things to hide for himself and that hideous excuse for a mayor.  The "issuing authority."

Judge finds public access channel’s rules unconstitutional

Judge finds public access channel’s rules unconstitutional

A federal court ruled that several rules of a Massachusetts public access channel unnecessarily restricted free speech rights and interfered with the newsgathering ability of two people who used the public access channel.
A federal judge on Feb. 28 granted two producers of a public access television show aired in Athol, Mass., a preliminary injunction against the cable television station, which had barred them from production for breaking three of its rules.

Demarest and co-producer Vicki Dunn brought the case against the station after AOTV's board of directors suspended Demarest for airing an interview she conducted with a local official in July 2000. The official claimed that he was unaware Demarest was recording their conversation, a violation of one of the station's rules that requires written permission from all parties before they can be recorded.

There's a reason why Jay Campbell is intentionally tardy in filing the Public Notice required by the OPEN MEETING LAW.
They do NOT want you using access TV.  They do NOT want you attending meetings of the Cable Advisory Board.  They want you
OUT of their FACE.

Public Accommodation
The Attorney General's Office enforces state and federal laws prohibiting discrimination in places of public accommodation. The Massachusetts Public Accommodation Law (M.G.L c. 272, §§ 92A, 98 and 98A) prohibits, among other things, making any distinction, discrimination, or restriction in admission to or treatment in a place of public accommodation based on race, color, religious creed, national origin, sex, gender identity, sexual orientation, deafness, blindness, or any physical or mental disability, or ancestry.

Laws
M.G.L. c. 272, § 92A, defines a place of public accommodation as "any place, whether licensed or unlicensed, which is open to and accepts or solicits the patronage of the general public."
