Dear Public Records Division
In my records request Sent: Saturday, October 23, 2021 4:53 PM and Lt. Casey's response of Nov 8 2021, I do not believe the 90 days to appeal has expired.
A records custodian must comply with a request for records within ten (10) business days. If a custodian fails to respond within ten (10) business days, a requester may file an appeal, so long as the appeal is filed within ninety (90) calendar days of the request

a)If this has expired, may I refile with new information?
B)in Cronin -v-town of Amesbury please note:
The Letter https://casetext.com/case/cronin-v-town-of-amesbury-2
Summary of this case from Mercure v. Van Buren Tp.
Moreover, as pointed out earlier, the right
to privacy of a public employee is a limited one,
and the contours of that right were not clearly
established in 1992 or today.
In the circumstances of this case, the court concludes
established in 1992 or today.
In the circumstances of this case, the court concludes
that the town and the individual members of
the Board of Selectmen did not abrogate
plaintiff's clearly established
privacy rights by public disclosure.
I seek the Bank of America photographs DENIED this journalist AFTER
the Medford Police Department approved that my news outlet receive
the April 1, 2021 police report on city councilor
the April 1, 2021 police report on city councilor
Adam Knight.
These photographs are of great public interest
as Knight was able to somewhat diffuse his awkward position
(a criminal complaint application by the Medford Police)
with his use of the
weekly Medford Transcript, something
that public figures enjoy - to the detriment of the public.
Knight used the Weekly Transcript (Kinga Borondy of that
The public never knew about the September 24, 2021
magistrate hearing at Somerville District Court,
which was "continued."
Adam Knight was re-elected in November of 2021 in part
because the public was deprived the knowledge
of the "wanton" destruction of a bank door.
Knight used the Weekly Transcript (Kinga Borondy of that
publication is in the CC and may want to file her own records request)
to claim it "wasn't a story," when it was the biggest news story
of April, 2021, in my opinion.
My blog and Facebook page obtained lots of interest.
Since the Cronin v Town of Amesbury case notes
"the right to privacy of a public employee is a limited one..."
and this Knight complaint filed by the Medford Police is of
great public interest, I am again appealing the DENIAL
of the Medford Police to hand over the photos.
Along with what I believe was intentional and malicious
ELECTION INTERFERENCE by not
releasing the photographs of a dangerous
and volatile public official,
I also submit that the photographs may be of
such a deleterious nature that other abuse I will not mention
in this document allegedly could be revealed.
Another government agency is in touch with me in regards to that issue.
The photographs are essential to the citizens of Medford.
The City Council itself
is engaging in bizarre behavior in regards to these photos.
This journalist was
DENIED speech at the city council on a number of occasions.
That will be dealt
with in a Presentment letter to the city for possible litigation and violation of the
oath of office vis-a-vis the First Amendment.
Not only was this writer DENIED
speech, the council was so fearful of the public
having knowledge that they
erased what little speech I said on the public video
filing of the minutes of the meeting.
Knight himself, so terrorized by the thought of the
public knowing of a potential
raise in pay allegedly concocted by the council,
called a paper of mine out of order (in regard to
potential pay raise) when he had no authorization to do so.
The issue of the council
repeatedly denying speech rights, on the very day
they took the oath of office (Jan 4, 2022)
is a slap in the face to the public paying outrageous
taxes in the city of Medford.
I respectfully request those photographs or
information from the Division on my
ability to refile (for) those photos in light of
the Cronin v. Town of Amesbury case.
Respectfully
Joe Viglione
