RE: City of Medford's General Fund
Dear Attorney Scanlon
A new public records request follows as you have failed to answer my questions regarding access TV and the General Fund.
Ms.Khan
passed the buck back to you in regards to public monies from access TV
going to the General Fund - and any coherent explanation of what monies
go in to the General Fund and come out of the General Fund.
What does one expect when a violent city clerk slugs a gay senior citizen, and the city council president lies to the police and loses in criminal court, 1/31/17?
When Mrs. Burke said to me on 5/10/17 "He's not my clerk" - throwing Clerk Ed Finn under the bus (didn't she hire him when she was a city councilor?) - and then tells me that I can publish her rants - well, it was truly a thing of beauty.
Pathetic that such ugly thuggish behavior happens on the 2nd floor of city hall. Mr. Finn's verbal and physical assault in 2015 followed a similar one that was front page news in April of 2010. Violent public servants who are lazy, arrogant and - with Finn and Fred Dello Russo looking half asleep at the city council week after week, unsightly, unprofessional, rude and a black eye on our city.
I
demand that the documents I requested be given to me regarding the
General Fund.
It should all be posted on the city website free of charge.
I realize city hall is angry with me for asking Building Commissioner Paul F Mochi about the selling of the valuable doors to Medford City Hall, just as the expensive wooden seats in City Hall vanished and now residents sit on uncomfortable plastic chairs (where did THAT money go?) but, ho hum, after years and years of this city hall getting away with it, it is time for alleged public servants to hold themselves accountable.

Shab Khan's smug e mail (below) is not what a public servant is supposed to write. Atty Scanlon demanded I go to Shab Khan, Ms. Khan was acting like Sgt.Schultz on Hogan's Heroes feigning she didn't know where the information I requested is (she's only budget and procurement) and now - after a month of stonewalling - Shab is passing the buck back to Attorney Scanlon who sent me to Khan in the first place.
A Star Trek quip would fit nicely here but this is no laughing matter. Documents being kept from the public view and months of passing the buck are both a huge red flag that Medford City Hall is in lockdown mode and documents on millions of dollars of public monies are a reason why Stephanie Burke refuses to meet with residents who ask the tough questions of her.

Muccini-Burke refused to talk to me yesterday at La Cascia's Bakery
where, on company time, she met with about six citizens that I could
see, during city hours, at a for-profit establishment during their lunch hour.

News Flash to Mayor Burke: a blog quoting her husband and requesting information on allegations that she,

Burke, as Director of Personnel, may have hushed up a sex crime during
the election, allegedly in concert with Medford High School
Superintendent Belson (who told a new employee "Joe thinks I hide sexual
predators at the high school",) Chief Leo A. Sacco Jr. of the Medford
Police Department and the former mayor, Michael J. McGlynn, is hardly "vulgar." It is simply mirroring the vile, vulgar, rude behavior of city hall!!!
So
how is reflecting Mrs. Burke's clerk-of-court's husband's foul mouth
and the outrageous allegations of multiple sexual predators posing as
teachers at Medford High School on a news page being "vulgar?"
And
why does that give the Burke Administration a pass on the Freedom of
Information Act? That only happens in Trumpland, not in a civil society
where millions of dollars in access TV fees are not accounted for in the
city of Medford.

After I issued a public records request you asked me to go to Shab Khan for information.
After
you Attorney Scanlon, asked me to go to budget, procurement officer
Shab Khan, Ms.Khan - who incredibly told me she didn't know about the
General Fund and access TV monies - said to give her "a few days" well
over a month ago.
This is a terrific expose, by the way, for the Medford Transcript and other news organizations.
Ms. Khan writes today, 5/11/17 "I
gave all the information to Kim Scanlon, Supervisor (Legal Department
who oversees all FOI requests). Please contact her for any and all
information you need. That is the

The "procedure" as mapped out by Attorney Scanlon was to go to Shab Khan.

Now they are passing the buck again, messing around with the FOIA / Public Records laws ...not being forthright, knowing that I broke the story on Teresa Walsh's exile from city hall, and the other employees Mrs. Burke couldn't keep onboard in the first 8 months of her Administration that makes Donald Trump look honest by comparison.

This is a request under the Massachusetts Public Records Law
(M. G. L. Chapter 66, Section 10). I am requesting that I be provided a
copy of the following records:
1)All
documents providing detailed information on the $600,000.00 or so per
year of public access television monies which go into the General Fund
2)All
documents providing information - detailed information - on where
"every nickel," to quote Mark E. Rumley, City Solicitor, where every
nickel of those public access / cable tv monies generated from the
franchise fee to Verizon and Comcast, is spent.
a)If
the money pays the bills of Medford Electronics, one of the city's
vendors operated by John Costas, another individual over at the
Chevalier in desperate need of term limits (has he been in there 25
years now? His term expires August 20, 2017. Give him the boot!!!) or if the monies are spent on watering the front lawn to
city hall, the citizens want to know. Where are the documents?
I
recognize that you may charge reasonable costs for copies, as well as
for personnel time needed to comply with this request, however, this is
information which the new public records law may advise posting for free
on the city website.

The
Public Records Law requires you to provide me with a
written response within 10 business days. If you cannot comply with my
request, you are statutorily required to provide an explanation in
writing, If it is another bunch of malarkey then we can start the process
over again and bring it into a court of law and put Ms. Khan and Mrs.
Burke under oath. They will, no doubt, have the Rick Caraviello
deer-in-the-headlights look on the witness stand, and we'll simply have a
lawyer drag the information out of them in front of judge and jury.
