Latin for "friend of the court." Plural is "amici curiae." Frequently, a
person or group who is not a party to an action, but has a strong
interest in the matter, will petition the court for permission to submit
a brief in the action with the intent of influencing the court's
decision. Such briefs are called "amicus briefs."
Dear Solicitor Scanlon:
This
is a document on behalf of Mayor Lungo-Koehn written by an established
and respected music journalist published in national and international
publications. I have been writing for over the past half a century
quoted in the New York Times, Boston Globe, and in more books than I can
count. "Tear sheets" available upon request.
When
Breanna Lungo-Koehn was elected it is rumored that Robert A. Maiocco,
former city council president said "She'll have a target on her back on
day 1."
It is 131 days to the November 2nd election. Please look at the timing of this complaint.
1)RETALIATION
Is it not
true that Mark E. Rumley was not given a ceremonious position in Medford
after the election of 2019? A fancy title that a man like Mark Rumley
covets above
public service. We'll come back to this issue as Mr. Rumley's arrogance has often blurred his judgment.
2)POSSIBLE CONFLICT OF INTEREST
At Breanna Lungo Koehn's inauguration I snapped a photo of attorney
Rumley with Michael J. McGlynn, the former mayor. Rumor has it that the
Lungo family and the McGlynn family are akin to a more civil version of
the Hatfield–McCoy feud (West Virginia-Kentucky, an all out family feud
war.) Mr. McGlynn - they say - lusted for his 30th year as mayor.
Strangely, McGlynn stepped down, totally out of character for yet
another individual who put himself above public service.
This may have
had something to do with the November 26, 2010 death of James V.
DiPaola, disgraced sheriff whose actions were in direct conflict with
his campaign promises. McGlynn and DiPaola were thick as thieves, and
the facts and allegations are in the public domain.
With
131 days to election time, and a city councilor - John Falco -
allegedly aligned with McGlynn having "pulled papers," along with the
current mayor, one sees a picture developing.
John Falco was alleged to
be "beaming" when the cease and desist was delivered allegedly on June
19, 2021 allegedly during the budget hearings. If you believe in
coincidences, go to the next paragraph; if you understand the
skullduggery that McGlynn and Rumley were involved in regarding the
finances of Medford Community Cablevision, Inc., where the books are
still open; where Rumley - who was a board member of MCC TV3 - decided
he would "investigate," only to damage the public by abandoning a
situation where about thirty-eight thousand dollars reported missing by
the Medford Transcript, you can see in that one instance the attorney,
Mark E. Rumley, not being forthright or honest with the citizens,
especially the cable TV subscribers, who were cheated out of their
access, and their franchise fees, which ran into the millions of dollars
Here
is a key glimpse into the Rumley/McGlynn modus operandi. During the
Judge Jackson Thompson 2nd hearing, around November of 2008 I believe,
Rumley made this odd statement about city government which suppresses
free speech: “The notion the city would censor or squelch free speech
is baseless and as city solicitor I would find any such effort

The
fact that McGlynn relied on Rumley to be the architect of the severe
censorship and press suppression in Medford makes attorney Rumley a bald
faced liar as well as an individual who took an oath to uphold honesty,
integrity and the U.S. Constitution.
Given Rumley's history as not only a bad actor, but one of the worst bad actors in Medford's history, makes any reasonable person pause and wonder if there is a conflict here beyond the obvious retaliation.
There appears to be
a fixation by McGlynn on all things Medford, the ex mayor's petty obsessions are bothersome,
often interfering in the best interests of the city, and are a stark indicator of Mike McGlynn's megalomania.
The entitlement of
an individual whose family has paid itself handsomely - through running
the city - and McGlynn's obvious and frightful mania, is clearly pathological.

violation of Rule 9 of the city council rules; city lawyer causing a
ruckus. You will NEVER see Solicitor Scanlon behaving in such a way.
The video eradicates Mark Rumley's voice in a sharp and definite way.
Michael Marks asks City Solicitor Mark E. Rumley the right questions, and Rumley answers like a sophomoric, entitled brat.
The self-centered city lawyer, Rumley, is all about his own money grab, not about the welfare of the city of Medford.
Rumley's histrionics are an embarrassment to our city. His flowery speech is all hot air and zero substance.
Solicitor Mark E. Rumley must be removed from Medford City Government.
He is a pathological liar derelict in his obligations and duties to this city. He's also conflicted on multiple levels.
Mayor Breanna Lungo-Koehn knows his history. She must fight back, legally and quickly.

The Medford City Council and the body's LACK OF HONESTY:
Rumley
Writes: "...while I do not represent the City Council...a baseless and
offensive indictment of that Honorable Body which has not taken any
action, passed any resolution or taken any position that would warrant
such a hateful thought."
If the statement is untrue, Mayor Lungo-Koehn needs to use her legal skills to fight back
But
here is where any reasonable person needs to take exception to Mr.
Rumley's rants, and unlike Rumley, this writer will provide the
evidence.
Rumley claims that the mayor stated
that the city council will (only) listen to a white male" See Page 1,
Paragraph 4 "since they will listen to a white male."
Rumley
calls the council, currently with three Open Meeting Law alleged
violations pending for not listening to a disabled, homosexual, elder
white male,
"honorable." By Rumley's low standards the
untrustworthy city council is "honorable," but not by any sane,
reasonable person. The facts will prove that.
The facts.
A)The overpaid city council, which votes for its own pay raises, is one of the most expensive in the Commonwealth
For the monies taxpayers have to give these untrustworthy individuals, it is a bad deal.
The town of Wakefield purportedly has volunteer selectmen.
Is the overpaid council why Atty Rumley feels the body is so "honorable"?
B)For
Thirty-One Thousand Dollars a year, Council Vice President Adam Knight
had no right to heckle the Director of Public Health on June 1,
especially while the
police have an investigation of criminal behavior alleged by Knight presently happening
C)Former
City Council president, biased Robert A. Maiocco threatened a man with a
dirty metal "rebar" after the Route 93 bridges were repaired.
Then
police chief Leo A. Sacco Jr. wrote the victim that what Maiocco did
was "inappropriate," but - of course - Sacco wasn't going to press
charges.
The victim then found a purported 1.7
million dollar complaint filed against Maiocco and Wells Fargo, and
other claims, and Maiocco never ran for council again.
Is this the "honorable" council that Mark Rumley is praising in his Cease and Desist complaint?

E)Council President Rick
Caraviello has stopped a petitioner from speaking four times because
Caraviello lost in criminal court 1/31/17.
It's
called retaliation, it's a violation of his oath of office and
unethical. Caraviello committed a crime when he lied to the police, and
then
allegedly committed perjury in a court of law. He still lost.
The
city clerk, Ed Finn, slugged an elder homosexual male. Not very
honorable. That's a fact because the police went after the victim with
a
false "witness intimidation" charge...one theory is that Mark Rumley
allegedly instigated the sick affair or was part of the conspiracy.
He
was the city lawyer after all. Finn snubbed a subpoena to criminal
court where, had he testified, they could have pressed charges on
him given the fact that the police threw Finn under the bus to make up a phony case against a journalist.
This is the alleged "HONOR" that Mark Rumley is trying to sell (poorly) because he knows Breanna doesn't know how to fight back.
F)Michael
Marks use to be aligned with the despicable Paul Camuso and Fred Dello
Russo Jr. Remember that. Then he flipped sides
and voted with Breanna. People forget what a snake Marks is.
Marks intimidated a witness to Ed Finn's crime, felony assault. Witness intimidation is a felony. Marks was never charged.
This is the "HONOR" Mark Rumley must be describing in his complaint against the mayor.
Allegedly, April 2018 at the access station, a witness states that Michael Marks said "Joe Viglione is right."
Keep that in mind.
G)In
May, current clerk Adam Hurtubise molested a petition to the city
council; destroyed it and wrote his own fiction, allegedly in collusion
with Council President Caraviello so that Caraviello could falsely call
a petition he never saw "out of order," and delay it for 90 days.
This was a conspiracy to protect Adam Knight and the criminal investigation currently underway.
In
Mark Rumley's unclean hands, that's "HONOR"...but to any reasonable
person, why was Mark Rumley never hired by a major Boston law firm
the
way Martha Coakley was? Because without his boss, Mike McGlynn,
Rumley would be lucky to get a job at Waste Management throwing garbage
away.
But Breanna, with the evidence, and being a lawyer, won't fight her former solicitor when she was on the council.
58,000 or so Medford residents are disgusted with the posing, the lies, the selfish motives.
Now
is Breanna Lungo-Koehn's time to show that she is a leader: fire Neil
Osborne, fire Dave Rodrigues, circle the wagons and slap Rumley down.
H)This journalist had Judge Yee remove Rumley from a witness stand for not being a witness. One word: "Objection."
That's all it took for Dorothy (me) to throw the water at the Wicked Witch of the East and West, and melt witch Rumley away.
What
was Rumley doing on a witness stand? He was given a subpoena by a
stalker, had no voice in the case, didn't go to the court to tell them
he had nothing to offer,
but Rumley was there to
attack the victim of the stalking activities. With malice, and glee,
Rumley was throwing rocks at the victim and the judge removed him.
That's
how dishonest Mark E. Rumley is. Using his taxpayer-funded e mail on
the Immaculate Conception church website (I have a screen shot,) not
separating
church and state, but thinking, like Caraviello, that he is above the law. LIke Adam Knight.
There is no honor at the corrupt and overpaid Medford City Council and the two bogus clerks who do the bidding of their masters.
IN CONCLUSION:
BREANNA HAS TO FIGHT BACK AND FIGHT BACK HARD WITH EVERY LEGAL TOOL IN HER ARSENAL.
I
submit that Mark Rumley's ethics are lacking, that his logic is skewed,
and that this is a vendetta by a city lawyer whose once powerful
position was taken from him by the failure of his boss, Michael J.
McGlynn to retain power.
Is Rumley ANGRY that Breanna Lungo-Koehn would not make him "of counsel" when he allegedly retired?
Is this RETALIATION and part of a plot by the McGlynn crowd to cast aspersions on a sitting mayor at election time?
MARK E. RUMLEY IS AS DIRTY AS THE MEDFORD CITY COUNCIL AND ITS CLERKS.
THE TAXPAYERS AND VOTERS DESERVE BETTER THAN THE SWINDLE AND COUP THEY ARE ATTEMPTING.
The timing is so obvious, 131 days from election day.
