Editorial: MacGilvray Must Resign

 An Editorial on the Ongoing Investigation of the Medford Police Department   


Medford elected officials and some of the police officers demand the highest of standards from "the people" while maintaining the lowest of standards for themselves.  The Lebert incident was the tip of the iceberg, yet ex Medford officer Stephen Lebert never fully paid the price for his crime against a Malden resident, and his past crimes.  Mr. LeBert actually thought he would stay on the force.   Chief Leo Sacco appeared to have one set of standards for whistleblowers (not only ignore them, spread vicious rumors about them allegedly) while ensuring that a member or members of his own family were not held accountable.  These weren't just anomalies, this is how business was conducted when the biggest crook that we know of - the author of The Cops are Robbers - now looks prophetic 41 years later.   As a person, I respected and like Harry MacGilvray. Until today I haven't posted ALL the information on the Hillary Clinton incidents.  My position is this, as head of the Police Patrolman Association Mr. MacGilvray should have been held to the HIGHEST of standards...hardly a rookie.  When the Islam comment was posted on Facebook by a Medford police officer the mayor Stephanie Muccini-Burke, did go overboard, it could have been an error and maybe the officer in question meant Isis, and not a religion, BUT, these officers are veterans of the police department and know the rules.   I personally told about four officers, including Monty and Harry, at Dunkin Donuts, that as a writer I have First Amendment rights that lawyers and police officers do not have.  The government has a post where Harry signed off on, that every officers KNOWS about "political activity." As a lawyer I know said to me about the situation "I"m a lawyer 24 hours a day, seven days a week."  He actually uses a typewriter because he doesn't want to make an error on the web.  Commendable as his court filings are impeccable.  He ensures that nothing will be misconstrued by not even posting on the internet.

JUST as officers of the law KNOW about political activity being out of bounds, the people who judge us if we are driving or protesting, Harry and others have displayed double standards - and this during a critical election where Hillary Clinton won the popular vote and the worst president in the history of this great nation had help from James Comey's error in judgment and Vladmir Putin.  We now know during the first impeachment of Trump that he would solicit help from other countries...despicable and criminal.


If Mr. MacGilvray has to go into court because he thinks he caught someone speeding or even jaywalking ($1.00 fine.  I have a photo of the new council president jaywalking...get that buck!) even a public defender can waltz into a courtroom and say to judge and jury "Officer MacGilvray knew he was conflicted, paid the price for it, is the President of the Patrolman's Association in Medford where there are more Brady cops than anywhere else in Middlesex Country, and he hitched his wagon to Donald Tump in violation of  MPD rules and possibly his oath of office."  Just as all the Brady-listed cops lack some credibility in civil or criminal court, Harry, as much as I like him, went overboard.  Denying it and shrugging it off, and the "Oh, he's a great guy from a good family" ignores the fact that the Medford Police have gone after innocent people to attempt to shut them up.  The current chief of police coddles the wrongdoers in exactly the same fashion that ex Chief Leo A Sacco Jr. did and it is absolutely disgusting, vile and inappropriate.


If they want to come after this journalist for enlightening the public, well, I've been to that rodeo before and have a plethora of information I haven't published ANYWHERE as some protection to use in a court of law, should that arise. 


Harry, it really is time to resign.  Police officers at the Capitol, plural, are dead because of Donald J. Trump and you broke the rules of the MPD to endorse the con artist / criminal.  Don't you get it?  Of course you do, you just don't want to hold yourself to the standard that you hold the residents to...which is exactly why the MPD has the worst record in D.A. Marian Ryan's files.   Don't blame the messenger, it is the District Attorney keeping the scorecard, I'm just the guy victimized by your anti-free speech police department that makes up phony charges and gets thrown out of court.  I unleashed the L'Italien Report and the Brady list not as retribution, but to give the public a clue.   The public's right to know that Medford has more untrustworthy police officers than any other department in Middlesex County.  You, as head of the police union, must do some soul searching that maybe your leadership skills aren't what they should be.  32 or so officers on the Brady list, and you haven't made a sensible public statement about that and why Medford citizens should put up with that?  That, and your support of a criminal like Trump, are why I am asking you to resign.

In the proposed Disposition Agreement, Respondent Harold MacGilvray admits that he violated G.L. c. 268A, § 23(b)(2)(ii), by causing the public posting and dissemination of two photographs of himself and other officers in uniform with images and captions implying Medford Police Department (“MPD”) disapproval of presidential candidate Hillary Clinton and approval of presidential candidate Donald Trump.[[1]](https://www.mass.gov/order/in-the-matter-of-harold-macgilvray-final-order#_ftn1)  The Disposition Agreement identifies several circumstances that were considered in the resolution of this matter, including the fact that Respondent received an official letter of reprimand for violating MPD’s prohibition against political activity, and was required to post a formal letter of apology to the public on the Medford Police Patrolmen’s Association website.  Further, the Respondent cooperated fully with the Commission’s investigation, he has served the City of Medford with distinction over the course of his career, and he testified that he did not request to be given copies of the photographs.


The Respondent agrees to pay a civil penalty of $1,500 and to waive all rights to contest the findings of fact, conclusions of law and terms and conditions contained in the Disposition Agreement in this and any other administrative or judicial proceeding to which the Commission is or may be a party.  Respondent has tendered the payment of the $1,500 civil penalty.
