      Medford Community Cablevision, Inc.

Dear Keeper of the Records:
This is a request under the Massachusetts Public Records Law (M. G. L. Chapter 66, Section 10). 
I am CC:ing the mayor elect of Medford, Breanna Lungo-Koehn 
As your office is aware, I have been investigating the 501c3 non-profit Medford Community Cablevision, Inc.

Before the request is made an important note.
1)April 17, 2019 your office responded.  I did not appeal the response in time but was told that I could appeal.  That appeal was made and denied due to the fact that, as I had noted in advance, I missed the deadline.
2)A (attached) Tuesday, October 1, 2013 11:05 am correspondence from Frank Pilleri, is enclosed.  Mr. Pilleri is someone who allegedly appointed himself to the board of directors using ex board members names to form an allegedly phony "quorum." That should be investigated. 
The attached document is Pilleri writing to a former board member of Medford Community Cablevision, Inc. (hereinafter MCC TV3), Solicitor Mark Rumley, in regards to some alleged shady deal made with the Mayor of Medford, Michael J. McGlynn to get MCC TV3 off the hook.
It appears that MCC TV3 agreed to shut down rather than face alleged charges.   
At this point of time there were charges of racism made against the station.  Indeed, City Solicitor Rumley joked in his office to me that "they" (his board of directors) were "equal opportunity slappers."  That Mr. Rumley, an attorney who took an oath of office, laughed at the blatant senior bashing, gay bashing, women-bashing cohorts says more about Rumley's lack of integrity than it does about the hateful organization that a retired judge deemed was a "private" MCC access, for the board members only.
Access television legend Joseph Fortunato made the same comment that MCC TV3 was "private public access" years before retired judge Marie O. Jackson-Thompson wrote her report condemning the station.
What is equally troublesome is that Solicitor Rumley told me he was "faxing back and forth" with the judge, which says to me that the $3900.00 the city paid the judge allegedly got whitewashed by the city's law office so that Mayor McGlynn could have a useless report as a dog and pony show.
McGlynn met with members of MCCTV3 at Bocelli's and Regina Pizza and failed to take notes, abusing the ten thousand dollars or so in an audit that Pilleri and his crew failed to comply with.  When I wrote for the Medford Transcript the editor, Nell Escobar Coakley, told me that she heard they were sending blank pages through to the auditors.  Intentional blank pages allegedly were sent so that Harvey Alberg and Ron Delucia - both alleged "money managers," Mr. Pilleri and Mr. Arthur Alan Deluca laughing at the expense of 10k to the auditors and $3900.00 to the judge.
I alert the AG's office to this information as the public has a right to know. 
The Attorney General's office has repeatedly denied my requests claiming for the past six years or so that "law enforcement" could be "impeded."  With a statute of limitation out there this public access host (spanning the past 40 years, starting in 1979) is concerned that due to the previous attorney general's close ties to ex mayor McGlynn, and the current AG's seeming ties to the exiting mayor, Stephanie Muccini-Burke, and District Attorney Marian Ryan definitely being in Muccini-Burke's "camp" - justice is not being served, let alone the public interest.
So, before my request is made I am alerting you to a recent determination by the Secretary of State's office, which I have also attached.  
Page 3 of SPR19-2081 addressed to the Assistant City Solicitor of Medford, Kimberly M. Scanlon, Esq, notes very clearly in Paragraph 3:
"Courts have contrasted the public status of disciplinary investigation materials of law enforcement personnel from the "ordinary evaluations, performance assessments and disciplinary determinations" included in the public records exemption for "personnel (file) or information" ...due to the significance of maintaining the transparency...
...The Appeals Court reasoned that openness in a police investigatory process, facilitated by the release of the relevant documents was necessary to foster the public trust in law enforcement."
The Public Charities Division, I believe, wrongfully hides behind this "law enforcement" excuse when the public's right to know is paramount. 
The key here, and this is my argument, is in paragraph 2: "Nevertheless, there is a strong public interest in monitoring public expenditures..."
Ratepayers of cable access TV, especially the notorious Comcast, Verizon and RCN, among others, are in the dark as to how much of a franchise fee they actually pay (God knows I have trouble reading the fine print on the bill, and you know how deep into investigating the process that this writer is) - so we don't know how much really comes off of our bill, how much money the cable providers pay a city hall, how much of that money in Medford goes into a "general fund," why about $200,000.00 of that money was paid to teachers Allison Goldsberry (former MCC TV3 board member,) Lisa Dunphy and Jack Dempsey. It's absurd and those monies would have been better served purchasing a building as Stoneham, Winthrop and other access television stations have done. Investing rather than squandering.
There is a strong public interest in monitoring PUBLIC expenditures, and your office is fighting me tooth and nail to STOP the public from this strong public interest that is the law.
I'm certain you will force me to appeal my request again. I am letting you know in advance that:
a)I won the determination when it came to the Medford police compensation fraud case
b)that I am utilizing that determination in my demand for the records I have been requesting for the better part of six years.   
On to the request:
I am requesting that I be provided a copy of the following records:
1)All documents that the Public Charities Division or Attorney General's office has regarding the dissolution of Medford Community Cablevision, Inc. Identification Number: 222488492.   For the reasons stated above, that the public interest in monitoring public expenditures is paramount, I do not want to hear that "law enforcement" may be impeded. My God it's been six years, how many years does your office need?  60?  600?  This just doesn't feel right to the public that has a right to know.
2)Documents regarding similar 501c3's - be they P/E/G access or not, in regards to the length of time to make a determination.
3)All documents which note that the board of directors' members were "exonerated."
Arthur Deluca of the MCC TV3 board and another board member or two claim that they have been "exonerated."  If this is so, the public has a right to know. We can't take the word of a board of directors that faced very public charges of racism.  Where a fellow board member, Mark Rumley, noted that they discriminated against everyone as "equal opportunity slappers."
Given Frank Pilleri's alleged abuse of ex board member names to allegedly appoint himself president, which would make any decisions by any board at that point "the fruit of the poisonous tree," and given Arthur Deluca's stalking behavior - to the point where Elder Affairs had to visit his home and investigate him, and the public smearing and lies of Ronald Delucia (Delucia told the city council that a man was "convicted of libel."  Essentially, Delucia, a bully, said a man was convicted of a crime to the city council and it simply was slander which turned into libel once the slander went on tape and became a public record.  Harvey Alberg went to the council and went on a rampage attempting to smear a resident. Councilor Stephanie Muccini-Burke (prior to becoming mayor) stopped the crazed old loon before he could do further damage to the public.
In court documents a lawyer wrote that these individuals "brutalized."
Brutalized.   A TV special entitled "Spotlight on City Hall" was hideous with Delucia, Alberg and the TV3 attorney maliciously attacking residents of Medford.
The AG's office dragging its feet is doing additional public damage enabling those disrespectful and vicious individuals.  Are there documents "exonerating" the hate-speech prone stalking individuals who were found by the courts to have violated the anti-SLAPP law three times?

McGlynn, Stephanie Muccini-Burke or Mark E. Rumley
4)All documents - thus far - in the Public Charities investigation of MCC TV3
I recognize that you may charge reasonable costs for copies, as well as for personnel time needed to comply with this request, however, as I am a journalist serving the public, my online blog with this exact figure at 11:39 am 11/26/18

The public has a serious right to know where their access TV P/E/G franchise fee monies are, or how they were spent.  Thus I am kindly requesting you waive any fees so that the public can have the information that the public deserves.  Failing to be forthright and transparent by delivering the documents requested, I believe, is not in the public interest and is a dereliction of duty.
The Public Records Law requires you to provide me with a written response within 10 business days. If you cannot comply with my request, you are statutorily required to provide an explanation in writing.
