The Pat Gordon Disaster - That's IT, People...time to sue the Mayor, Mr. Gordon and the entire City Council of Medfraud

To Clerk Hurtubise:

The Zoom was not functioning properly interfering in free speech rights at the Medford City Council on December 22, 2020.

For a city of 60,000 people - something the Alliance for Community Media is probably not aware of - with approximately one million dollars in funding per year (I'm awaiting
a new public records request response) - the citizens are again denied free speech rights.

City councilors joked about it and praised the individual responsible for the failed audio on Zoom, Patrick Gordon.  There was also some remark clearly aimed at me about
"sabotage."   No need to sabotage an incompetent like Patrick Gordon being praised by a deficient group of seven city councilors.

On Mon, Dec 14 at 9:00 AM you wrote me about participation at the city council.

I especially wanted to alert the community about the pay-to-play phony "award" from a non-profit, the Alliance for Community Media, which sells these awards
for an application fee. 

Due to harassment by councilors (filed with Neil Osborne a few years back; Osborne did nothing, he's another phony,) the last thing I wanted to do was subject myself to intentional audio disruption to deny me my free speech rights, just as Mayor Breanna Lungo-Koehn is shamefully doing when she personally writes me to
"get a sponsor."

1)I demand that a city receiving approximately one million dollars find an efficient platform, one that performs better than Zoom

2)With all that money - sixty percent or so in the general fund, twenty-percent spent on teacher salaries, if city hall is still engaging in that wrongful conduct - one would  think that having a qualified station manager who can deliver internet, classes and Twitter outreach - would be a priority for the mayor's claims of "unity," "community," "integrity," - none of which has been witnessed by those in the community paying Breanna Lungo-Koehn her handsome salary.

The mayor's failure to hire someone other than Stephanie Muccini-Burke's leftovers - a poor choice at that - and to have reliable internet for a council meeting in a pandemic is a slap in the face to the cable subscribers forking over huge fees that are invisible to most of the public

3)A city of sixty thousand or so with a station in the "under $300,000.00" category is disingenuous.  There's not a non-profit running on 200k anymore, as MCC TV3 was; this is a government control channel with a budget of about a million dollars.   Sure, the issuing authority - a lawyer at that - can falsely claim the budget is 200k, but that's alleged fraud.

    And this veteran of access TV submits that Patrick Gordon allegedly committed fraud to get the award.  He didn't submit any paperwork to prove that the station is an independent non-profit, which it isn't.  It is city-owned access and the Alliance for Community Media is aware, thanks to my efforts, about it being a GOVERNMENT channel and High School Channel with the public, quite literally, left out in the cold.

The "under 300,000.00 $" award is a category that generally doesn't get much attention.  That's why the defunct Medford Community Cablevision, Inc. stuffed the ballots with allegedly hundreds of dollars in application fees.   That wasn't public access, it was an abuse of access fees.  However, they were telling the truth, at least in
that case, as they got only 200k.   

Mr. Gordon, using the high school studio and his seventy thousand dollar or so paycheck, might be "allocated" 200k for certain things, but the "public" takes a back seat to the educational and governmental aspects of access television.  It's a scam with policies and procedures designed to keep the public out.

The seven city councilors are hardly experts on access television while I have experience spanning for years, from 1979 to present day, 2020 and beyond.
 
Praise from George Scarpelli - a failed chaperone who had rapes allegedly happen on his watch, a councilor (Bears) in an organization with a convicted felon who failed to be upfront with the community come election time, praising Patrick Gordon WHILE the internet was fluctuating, was the epitome of hypocrisy.

Patrick Gordon is the "Rosie Ruiz" of Access Television.  She jumped into the Boston marathon towards the end of the arduous run, claimed the prize, and was ousted, ridiculed, and became an example of a major cheat.

Patrick Gordon is such a cheat.   His failure to do proper outreach on Twitter, his sucking up to government officials, his failure to have classes that matter, is the decay of free speech in
Medford.  And then, like Rosie Ruiz, he doesn't win an award on merit, he purchases one by submitting to an allegedly inappropriate category, forks over cash that could have been spent more efficiently on computer programs, and gets praised by the stooges on the city council, stooges with very unclean hands.

That people can't speak to the council on Zoom due to Mr. Gordon's incompetence is more 1st Amendment interference by Medford City Hall.

PUBLIC ACCOMMODATIONS
I have filed a complaint with the Attorney General's office on this unacceptable private government access with Cori checks for grandma and policies and procedures designed to defame honest, hard-working volunteer producers if Mr. Gordon decides to point the finger and blame them for violating insane Rumley rules that would make Vladmir Putin blush with envy.

I submit that the policies and procedures devised by Mr. Rumley are detrimental to freedom of the press and free speech, and I intend to prove it in a court of law.

We will not be ridiculed by using Patrick Gordon's deficient Zoom, and the community paying the franchise fee gets screwed harshly by Mayor Breanna Lungo-Koehn.

I direct you to the precedent, Demarest vs. Athol / Orange in regards to free speech and public accommodations.   The Cori-check-for-grandma is a dog whistle to keep people with political ambitions from having their own programs, and to deny the public the free speech soap box:

B. Public Forum

Plaintiffs argue that, as well as being a state actor, AOTV is a "public forum" within the meaning of the First Amendment. Again, this question is open to debate.

Justices Kennedy and Ginsburg appear to agree with plaintiffs. In Denver Area *92 Educational Telecommunications Consortium, Inc. v. FCC, 518 U.S. 727, 116 S. Ct. 2374, 135 L. Ed. 2d 888 (1996), Justice Kennedy's concurrence made it very clear that he and Justice Ginsburg believed that "[a] public access channel is a public forum." Id. at 783, 116 S. Ct. 2374 (concurring in part, dissenting in part). Justice Kennedy observed that a channel like AOTV is "open to programming by the public." Id. at 790, 116 S. Ct. 2374. He also pointed out that the House Report "characterized public access channels as `the video equivalent of the speaker's soap box or the electronic parallel to the printed leaflet.'" Id. at 791, 116 S. Ct. 2374, quoting H.R.Rep. No. 98-934 at 30.


Breanna's a lawyer.  It shouldn't take her too long to skim that portion of the Demarest case to see the harm that she, the mayor, is directly causing the community.

If Mr. Gordon accepts a suspicious and questionable Rosie Ruiz pay-to-play award while the internet is fluctuating, as he gets some Wizard-of-Oz proclamation from the city council
and the Zoom is not working WHILE he accepts the fraudulent praise, which he did, then we have evidence to bring into court to show the hypocrisy.

This writer/journalist/veteran of access TV can help the city of Medford get on the right track.

I shut down MCC TV3.   I am determined to expose this fraudulent access television Patrick Gordon is selling...and selling not very well.

Breanna can be arrogant and ignore the truth, and I can make an example of her in the courtroom, just as I embarrassed Mark E. Rumley for his stupidity on the witness stand, when the judge ruled he wasn't even a witness with his "irrelevant" testimony.

Medford cannot grow and improve with such lunacy    Mark Rumley, former board member, investigates MCC TV3, and drops the investigation on his own board of directors.
Nice to have such a Donald Trump styled get out of trouble pass, courtesy of a former city solicitor.  But is that helpful to the city of Medford?

Crony entrenched was what MCC TV3 was.  I shut it down.  

"You're a determined man" the late George Skaubitis of Warner Brothers Records called me.

My friend George was right.   Want me to prove it again?

My pal Breanna - of all people - cheated me out of access television.

And the city council on 12/22/2020 was abysmal on Zoom after all these years of incompetence.  Under Pat Gordon nothing has changed. As incompetent as ever.

I want my membership and my shows played.

The reason it isn't happening?  Patrick Gordon is incapable of servicing real access producers, producers he is jealous of.

What a total disaster...with all that money that I saved the city, Gordon comes in - a Stephanie Burke appointee - like a bull in a china shop.

That is NOT P/E/G access.

Fix the situation.
