BAKER EXTENDS EVICTION MORATORIUM FOR 60 DAYS
During
this 60-day extension, the Administration will consult with the court
administrators and other stakeholder regarding programs and policies to
help tenants avoid eviction when proceedings resume.
The 60-day extension is in sharp contrast to HD. 5166 and SD.2992 which
would devastate the real estate industry. These bills which are still
pending before the legislature, would implement an eviction moratorium
lasting twelve-months from the end of the March 10 state of emergency.
Under this legislation, an owner would be prohibited from taking any
legal action to collect rent unless they could prove that the cause of
the non-payment was not, in any way, related to COVID-19.
Massachusetts has already created one of the strongest emergency housing
protection laws in the country, keeping the moratorium in effect until
at least Aug. 18. Beyond that date, the Legislature authorized the
Governor to extend the law’s protections indefinitely under the state of
emergency, and up to forty-five (45)-days after the state of emergency
has ended, in increments of up to ninety (90)-days at a time.
