A Boston police officer broke state law by creating a phony criminal complaint for his best friend’s brother, the Massachusetts State Ethics Commission announced on Wednesday.

BPD officer James Clark, who has been a police officer for more than 25 years, violated the state’s conflict of interest law by filling out that false criminal complaint application for his friend’s brother who was an MBTA bus driver.

When Clark created the phony police report in July 2016, he was a patrol officer in Brighton. His friend’s brother at the time was an MBTA bus driver under a “Last Chance Agreement,” which means he could be fired for violating the MBTA’s attendance policy.

Fearing he would lose his job after oversleeping and missing his shift on July 4, 2016, the bus driver decided to try to explain his absence by falsely claiming he got arrested, according to the State Ethics Commission’s Public Education Letter to Clark on Wednesday.

The fake police report showed that the bus driver was arrested in Brighton for assault and battery. The application listed a fictitious police officer’s name, and a female victim’s name and incident address.

Clark admitted to completing the false application for a criminal complaint, but told the Commission that he didn’t know the driver intended to use it to explain a work absence.

Clark said he believed his friend’s brother was using the criminal complaint application as an alibi to explain his whereabouts to his girlfriend.

BOSTON, MAMedford police officer Harold MacGilvray has paid a $1,500 civil penalty after admitting to violating the conflict of interest law by engaging in political activity while on duty and in uniform 10 days before the 2016 presidential election. The State Ethics Commission on October 23 issued a Final Order allowing a joint motion to dismiss the adjudicatory proceeding against MacGilvray after he paid the civil penalty and signed a disposition agreement in which he admitted the violation and waived his right to contest the Commission’s findings.
