Public Records Request on New TV3 Station Manager Medford ANTI-COMMUNITY MEDIA

RE:Documents on Station Manager Medford Community Media, etc.


Under the Massachusetts Public Records Act § 66-10 et seq.
I am requesting an opportunity to inspect or obtain copies of public records 
that involve the hiring of a new access television manager for the alleged public access 
station which is being operated as an educational and governmental station only.

1)All documents that show when the job for Medford Community Media manager posting 
was made public, including information on where the job was posted and when.

2)All informational documents on any complaints of use of the equipment at Medford Community Media 
for the purpose of transferring for sale copyrighted audio and video tapes in violation of 
the piracy rules set forth by the FBI and the Record Industry Association of America (RIAA) 
and the Federal Bureau of Investigation.

3)All documented station logs of members of Medford Community Media if their shows utilize 
videos and/or audio.

For example, a Steve Bertorelli utilized a copyrighted YouTube of a famous artist while at 
the prior Medford Community Cablevision, Inc.   
If the old MCCTV3 did not pay royalties to Sesac, BMI or Ascap, as well as Soundexchange, 
Mr. Bertorelli may have been in violation.  But that was not piracy.  

The piracy allegations are against a former board member of MCC TV3 who allegedly 
is a member of Medford Community Media   

The City of Medford could be liable if these allegations are true and the alleged 
pirate/bootlegger is still selling tapes at record shows and online, 
as well as via legitimate music magazines.

If true, the FBI and the RIAA could also consider a lawsuit against the high school 
where the alleged bootlegging may have occurred as well as the city itself.

FBI Anti-Piracy Warning Seal

A new federal regulation regarding the FBI’s Anti-Piracy Warning (APW) Seal took effect several years ago—41 CFR Section 128-1.5009 authorizes use of the APW Seal by all U.S. copyright holders, subject to specific conditions of use. Copyrighted works can include, but are not limited to, films, audio recordings, electronic media, software, books, photographs, etc. The purpose of the APW Seal is to remind media users of the serious consequences of pirating copyrighted works. Use of this seal does not indicate that the FBI has reviewed or validated copyright interests in the particular work and does not provide greater legal protection to the work. It simply serves as a widely recognizable reminder of the FBI’s authority and mission with respect to the protection of intellectual property rights.

5)The document(s) providing the background information on the alleged station manager 
who refused to give his last name on the phone Nov 1.  

Documents: whatever background information is available for public consumption on 
the mysterious "Kevin," the station manager, is necessary for the public...
and is of great public interest  

"Kevin" will be dealing with the public, and the fact that he 
slammed the phone in this access television producer's ear 
at 6:10 pm November 1 is a reason for the public to pause 
and look at the documents on this new hire.   

What "Kevin" did was censorship, elder abuse, abuse of 
a disabled person, breaking the law regarding 
public accommodations, and a failure to do outreach 
and build membership. 

The City of Medford hired convicted rapist Jenna Tarabelsi thinking that the public was stupid; 
The City of Medford's hires have been deficient in many cases.  
City management has proved itself blind to the needs of the public access producers of Medford, 
for thirty years or more.  Documents informing the public who this alleged 
Medford resident "Kevin" - is - given the lack of transparency of the Lungo-Koehn administration 
- is at the heart of this request. 

The documents showing Kevin's resume and alleged skills are hereby requested

6)I request the document showing the CURRENT membership of Medford Community Media, documents providing 
what the members paid or did not pay, and any complaint documents by members against the station, 
or the station against membership

If there are any fees for searching or copying these records, please inform me if the cost will exceed $5.00.  
However, I would also like to request a waiver of all fees in that the disclosure of the requested information is in the public interest and will contribute significantly to the public’s understanding of how government works.  As you know I am a film and music critic recently thanked in a new book by Beatles' critic  xxxxx xxxxx  This information is not being sought for commercial purposes.
 
As the Medford Police Department knows, and as ex solicitor Mark E. Rumley has stated 
"You do this for the public, no one would do this work for themselves"  Paraphrased.  

The Massachusetts Public Records Act requires a response to this request within 10 days.  

If access to the records I am requesting will take longer than this amount of time, 

please contact me with information about when I might expect copies or the ability 

to inspect the requested records.   

If you deny any or all of this request, please cite each specific exemption you feel 

justifies the refusal to release the information and notify me of the appeal procedures 

available to me under the law.
