RE: SPR21/2988   Additional Information

The City Solicitor is added to this as I've included the mayor in the CC,
not requesting that Atty Scanlon participate in the document request.

Dear Connor McElroy,

Enclosed is some additional information on my request for the April 1, 2021
photographs from the bank of America

1)Someone at the Bank of America Mystic Ave, Medford, or someone at the police
department, delivered two photographs to me prior to the election.

a)they are attached here

b)I advised the mayor and Lt. Casey that I had obtained photos

c)Obviously, someone inside the MPD or Bank of America deemed the photos
too important to be hidden from public view, yet these aren't the specific photos
that the public needs to see.

2)These photographs are of great public interest.
The citizens pay Adam Knight $30,000.00 approximately to be the vice president
of the city council.  Not to smash a bank door and allegedly flee at a "high rate of speed"
as the police report notes.

a)There are allegations from two alleged witnesses that Knight's two small children were
in the vehicle while Adam Knight engaged in what the police allege was "wanton" destruction
of the bank door, and fleeing at a "high rate of speed."

b)If you or I engaged in such dangerous behavior we would hardly have a secret hearing
in Cambridge District Court transferred from Somerville and have the case "open."

I have serious evidence of how the MPD goes after its  enemies with a smear campaign
in the Medford Transcript and the filing of false charges where retired officer Paul MacKowski
makes up a law that doesn't exist.  The MPD and Marian Ryan's office of the District Attorney
both lost when they pulled the illegal stunt, causing great harm to the victim of their malicious
abuse of process.

Mr. Casey's posturing does not "protect and serve," the public.  They are coddling a very
dangerous thug, Adam Knight, who has a short fuse, a wild temper, and because of the
failure of the MPD, voters/taxpayers couldn't vote Knight out of office this past election.

3)Despite ALL my public records requests to help the public the mayor and Lt. Casey didn't
have the decency to send me an update that there would be a hearing in Cambridge Court
on September 24, 2021.   This lack of transparency, this dancing in the dark, does serious
damage to the citizenry.    I have known Mr. Knight for close to a decade.  He engages
with a violent individual who was thrown off of the board of a 501c3 for attacking a man
at Medford City Hall (April 2010,) Knight himself exploding in rage if he's not happy
(that's when he's not heckling the Director of Public Health 6/1/21 from the council
itself.)

4)An article in today's Boston Globe on a judge's ruling on Donald Trump attempting to
suppress public information speaks volumes:

"In denying a preliminary injunction, U.S. District Judge Tanya Chutkan said Tuesday that Congress had
a strong public interest in obtaining records that could shed light on a violent insurrection mounted by the
 former president’s supporters.

She added that President Joe Biden had the authority to waive executive privilege
over the documents despite Trump’s assertions otherwise."

5)Mr. Knight doesn't just despise the current mayor, he loathes Mayor Lungo-Koehn
and is a puppet of a former mayor *(Michael J. McGlynn.)  The current mayor lashed
out at the "old boy network" at the debate in October.   It was more about her ego than
about protecting the public, but Lungo-Koehn was referencing McGlynn, John Falco,
Adam Knight and others who were trying to take her down.

Too bad Mayor Lungo-Koehn doesn't put that same energy into helping the public
with this problem created by Adam Knight, but like most Medford politicians, it is all
about the Mayor's selfish needs, put serving the public on the back burner.

If the mayor were as transparent as advertised, there would be no need for this public
records request.  The corruption in Medford is documented and is why I appreciate
the public records law, though my faith in it is waning when it comes to the public's
right to these essential documents.

That a mayor is protecting one of her enemies is perplexing.

These documents, photographs of a public figure, a VP of a city council, engaging
in allegedly illegal acts, are essential for the voters and taxpayers of Medford.

Your office granted me permission to receive them.  Lt. Casey appealed and
prevailed in his appeal.  It's odd.  Casey got me the police report in record time.

This journalist has seen it before and I believe Casey is being pressured either
by the police chief, the mayor, a former mayor, or all of the above.   When things like
that happen, the public is not served.

I believe that IF the two mayors and the chief are engaging in this type of behavior,
it is a serious violation of their oath of office.

These documents are not for me; I'm simply the messenger.  It is the public
paying Knight 30k this year (where the city of Woburn would pay about 12k)
that is getting cheated and has an absolute right to these documents.

Respectfully,

Joe Viglione

Mr. Viglione the complaint you referenced in your records request was transferred to Cambridge District Court, and a clerk magistrates hearing was held on September 24, 2021.  The complaint remains open at this time.

The Department has no documents as referenced in item 1, 3, and 4 of your request.  As per item 2 "Any photographs of the activities of April 1, 2021", the photographs remain withheld per exemption F, as the complaint remains open.

To Honorable Mayor Lungo-Koehn, Solicitor Scanlon, Lieutenant Casey:

1)Enclosed is my July 13, 2021 records request for reference.

2)April 1, 2021 - the date of the police report on Adam Knight and November 1, 2021, the day before the election, is seven full months.

This reporter has witnessed lots of strange, outlandish behavior by Medford government officials.  Protecting criminal activity by an Edward P. Finn or an Adam Knight (no "alleged" necessary, especially with
Finn ignoring a subpoena to criminal court 1/31/17, kinda says it all, doesn't it?) ...protecting criminal activity by those unpredictable and violent individuals is a disservice to the public that the police, and the
mayor, are paid to (and have sworn to) protect.

To be blunt: the taxpayers and the voters, usually one and the same.

I intentionally held this request back so that there would not be ten days before both government organizations are required to respond.

Yes, it is a test of the honesty of the police department and city government to see if you want to protect the many or protect the few insiders.

I believe Breanna said I would make a good lawyer one night at the city council.  Not the profession I chose, but a true statement, perhaps, only because I already know the answer before I ask it.

    PUBLIC RECORDS REQUEST

Dear Lt. Casey, Madame Mayor and Solicitor Scanlon:

Under the Massachusetts Public Records Act § 66-10 et seq., I am requesting an opportunity to inspect or obtain copies of public records that invole the vice president of the city council, Adam Knight:

1)Any documents that show an extension (or addition) to the police matter involving Mr. Knight and the events of April 1, 2021, or any additional new police matters involving the VP of the city council, Mr. Knight

2)Any photographs of the activities of April 1, 2021 now available for the public that were not available on July 13, 2021.

3)Any document the public may view on the police filing against Adam Knight now allegedly pending in Somerville District Court

4)If the Somerville Court hearing has been held, or is concluded, please send that document and the photographs no longer being held from the public paying for these matters.

If there are any fees for searching or copying these records, please inform me if the cost will exceed $5.00.  However, I would also like to request a waiver of all fees in that the disclosure of the requested information is in the public interest and will contribute significantly to the public’s understanding of how government works.  As you know I am a film and music critic recently thanked in a new book by Beatles' critic Charles Rosenay with tons of references to me on Wikipedia; Side note: JJ McLean PROMISED to repair the Wikipedia on me that TV3 wrecked, and reneged on his promise saying to me "I lie all the time."  Perhaps true, but the Supreme Court didn't sanction lying by the police, only lying during interrogations if my understanding of the law is correct.   See what I mean?   This information is not being sought for commercial purposes.

As the Medford Police Department knows, and as ex solicitor Mark E. Rumley has stated "You do this for the public, no one would do this work for themselves"  Paraphrased.  This information is even more valuable that we are  10 days from the election (not the 112 days from an election, Nov 2 as of July 13th,)  and the information you hold directly refutes what the council vice president is saying on the campaign trail.  As you also know, that is my argument as to why the photographs/videos and now the magistrate hearing are so vital for democracy in Medford.

The Massachusetts Public Records Act requires a response to this request within 10 days.  If access to the records I am requesting will take longer than this amount of time, please contact me with information about when I might expect copies or the ability to inspect the requested records.   10 days to the election, 7 business days to the election, Nov. 2.

I respectfully request that you can just send the material on any magistrate hearing, past or future, regarding the council vice president as time is of the essence.

If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.

Thank you for considering my request.

I prefer e mail rather than the P.O. box.

July 13, 2021  Public Records Request

    Joseph W. Casey,
    Medford Police Dept

Dear custodian of records and/or Lt. Casey:

Under the Massachusetts Public Records Act § 66-10 et seq., I am requesting an opportunity to inspect or obtain copies of public records that invole the vice president of the city council, Adam Knight:

1)On or about April 1, 2021 there was an incident involving the council vp and a door at the Bank of America on Mystic Ave.  Rumors are floating that Mr. Knight had a hearing on or about July 12, 2021 at Somerville District Court.   If there was a magistrate hearing, I respectfully request the document showing the hearing and the documents that are the result of the alleged hearing.

2)On or about June 1, 2021 as I was in the front row of the Alden Chambers at Medford City Hall, I and others witnessed the council vice president heckling the Director of Public Health, twice. As citizens are reprimanded, even when doing nothing wrong (council president recently had me move three seats down just to be a bully. I was quiet, of course.) Does the Medford Police Department have any documents from the council president reprimanding Adam Knight for the flagrant violation of council rules?  Is there a police report on an incident of an elected official behaving with very low standards and exposing his famous temper?

3)If the magistrate hearing has been held, may I have the photographs/video discussed in previous public records requests, including one still yet to be determined?

4)If there is an upcoming magistrate hearing, the public is entitled to at least the documents that there is a hearing, may I have them?

5)If possible, any Medford Police Department filing that there is a hearing, not requesting any other documents attached to those documents at this time, unless you are willing to provide them.

If there are any fees for searching or copying these records, please inform me if the cost will exceed $5.00.  However, I would also like to request a waiver of all fees in that the disclosure of the requested information is in the public interest and will contribute significantly to the public’s understanding of how government works.  As you know I am a film and music critic, my current review of The Black Widow (biggest film since February of 2020) on a number of publications at this time, as well as re-publishing of my past articles on Captain America films (which tie in with the Black Widow, of course) all to say that the public has great interest in what I've asked for in this request and general articles that I write. This information is not being sought for commercial purposes.

As the Medford Police Department knows, and as ex solicitor Mark E. Rumley has stated "You do this for the public, no one would do this work for themselves"  Paraphrased.  This information is even more valuable that we are 112 days from an election, Nov 2, and the information you hold directly refutes what the council vice president is saying on the campaign trail.  As you also know, that is my argument as to why the photographs/videos and now the magistrate hearing is so vital for democracy in Medford.

The Massachusetts Public Records Act requires a response to this request within 10 days.  If access to the records I am requesting will take longer than this amount of time, please contact me with information about when I might expect copies or the ability to inspect the requested records.

I respectfully request that you can just send the material on any magistrate hearing, past or future, regarding the council vice president as time is of the essence.

If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.
