Our State Rep has a problem sweeping his own stairwell in Medford (Paul, it's still a mess as of 2 days ago!) - why does a constituent have to do my representative's job for him?

This is the most highly guarded form of speech because of its purely expressive nature and importance to a functional republic. Restrictions placed upon core political speech must weather strict scrutiny analysis or they will be struck down.

Mr. Donato told me over a decade ago that Jack Dempsey would put my shows on the air "If they were educational."

Now I am demanding my shows air.  Krissy Fraser took my DVDs, the show never aired.  Patrick Gordon is jealous of my hard work and honest efforts.  Gordon - as evidenced by his actions - embraces the ugly TV3 crowd that are "scarecrows" keeping people out of access TV, including Art Deluca who had the audacity to even censor our representative, Paul J. Donato.

Demarest vs Athol/Orange

The court found:
``At base, plaintiffs had a constitutionally protected right
to record matters of public interest, see Smith v. City of
Cumming, 212 F.3d 1332, 1333 (11th Cir. 2000), cert. denied 531
U.S. 978 (2000); .... as applied to these plaintiffs, the Release Form
provision made no distinction between the newsworthy and the
mundane, or between matters of public interest and purely private
matters.

Rather than being tailored to protect legitimate interests
in privacy, the Release Form Provision made Athol's news makers
news editors. By refusing to sign a release form, Athol's news
makers could ensure that their images did not appear on AOTV. It
is highly probable that the filming which gave rise to Demarest's
suspension will be found to be constitutionally protected.``

Judge Says Amateur News Gatherers on Public Access TV Have Same Rights as Professionals

  BOSTON - A federal court has ruled that nonprofessional news gatherers have the same rights as professionals, supporting a community gadfly who claimed she was muzzled by a public access cable company.

It is the first ruling of its kind, said the American Civil Liberties Union, which represented plaintiff Patricia Demarest in her fight with Athol/Orange Community Television.

"It will open so many more doors for common citizens to use public access as a public forum and a place to speak their minds," said Demarest, co-producer of the program "Think Tank 2000."

"It's a fight for any common citizen to bring forth ideas and generate healthy communities."
