Questions linger on TV3 audit

To the editor: , there is still the presence of the embattled “Board of Directors” of Medford Community Cablevision, Inc. that concerns many residents and Comcast subscribers.
With decades of broken promises it is pretty hard to convince the people funding the channel that things will be different. Will positive changes continue if the current board survives the scrutiny of a retired judge, the mayor, the city solicitor, the City Council and the auditors at Melanson Heath & Co, PC?
Every aspect of TV3 with the old board in place will be viewed as “the fruit of the poisonous tree,” a product that is the decision of a board that has made terrible decisions on behalf of the access TV station. The only remedy is for an entirely new group of people to administer access TV in this city while removing the old board — and keeping individuals who served on that old board of directors away from the station for a good three to five years.
In light of the unanimous decision by the City Council of Medford on April 30 to demand the audit and Judge [Marie] Jackson’s evaluation and with the release of that audit by the city solicitor on May 7, it is not just one or two voices demanding change.

Every major politician, it seems, is as outraged as the community and the audit further provokes anger from Comcast subscribers paying a fee that we see being abused throughout the public record generated by the respected accountants of Melanson Heath & Company, PC.

It isn’t just the $818,000 that Mark Rumley began looking into, millions of dollars in subscriber paid fees have flowed to this station over the past two and a half decades with little or no accountability to those of us who are footing the bill.

If an elected official doesn’t do the job we hire them to do, the voters have a chance to replace that individual. Why have Comcast subscribers had less of a say in who handles our access channel and who gets to determine — or dictate — how these millions of dollars have been and will be spent?
Melanson Heath & Co. wrote: “We have concluded that we are unable to express an opinion because limitations have been placed on the scope of our audit as outlined in our report and the following paragraph.

A very good question is asked on Legal Guru.com:

Involuntary Dissolution by Court Order for a corpartion
if you need to file a small claims for a bill of 1800.00 and the corp is in a dissolution by court order can you sue the owner of the corp? or how long does this dissolution stay in affect before the sec. of state releases it and the name can be reused?

TV3 Medford is "technically not in compliance" with the Attorney General's office for its filing for the fiscal year.  They have until April 30, 2014 to do so.

What happens if the public is allegedly being deceived?  What if they have no plans to voluntarily dissolve in light of the Stanley Komins West Medford Hillside Little League situation?  Since the MCC board claims to have had a "board meeting" (meeting minutes?  quorum???) on September 30, 2013, with the Corporation claiming to initiate dissolution on or about October 3, 2013, it has almost been a half a year and the Attorney General's office and Woburn Superior Court have nothing thus far from the board of directors that attempts to control the conversation and force-feed the public their version of things.

Notice how any legitimate person questioning Frank Pilleri gets hit with "Witch hunt" (Judge Jackson Thompson,)  "Chumley" (the Rumley Report,) unkind words and alleged blank faxes for the tax-payer funded audit by Melanson Heath & Co that Mr. Pilleri told the weekly paper he "welcomed" but which Pilleri intentionally failed to cooperate with.

Frank Pilleri knows all, seize all (excuse please, "sees all") and has some swampland behind his house on Everett St. to sell you.  Maybe now is the time for the city to ask for those financial records or ask Mr. Pilleri for the house.  After all, he wrote 39 Everett on the Corporate Papers as the home of TV3 at one point, if he's to turn over all the assets, wouldn't 39 Everett be one of those assets?  And, equally important, did Mr. Pilleri ever charge rent to house the equipment of MCC TV3 at 39 Everett and, if so, did he have access to the equipment co-owned by the city that he refused to let the public have?

Despite having by-laws that called for 10-13 board members, a rogue element allegedly ran things contrary to Robert's Rules of Order, allegedly to benefit themselves - for their own personal gain and to the detriment of the community they were bound by contract to serve.

Citizens believe that the three "rogue" board members are the same trio that were on the Chumley Report on TV3 - Francis R. Pilleri, Jr (President), Harvey Alberg(Clerk) and Ronald Delucia (Vice President) allegedly locked Arthur Alan Deluca out of board meetings and allegedly reconvened without a quorum to re-vote on issues the full board (when they had a full board) had passed.

The casualty rate of board members (and advisers to the board) who left is chilling, and quite telling: Jay Ricci, Deric Dyer, John Costas, Phyllis Buccio-Notaro (a Mayoral appointee allegedly abused until she left,) Mark E. Rumley (another Mayoral appointee besmirched by the Chumley Report,) Bob DeNitale, Allison Goldsberry, Chrstine Barthelette, Matthew Haberstroh, Dr. William Wood, Carl Galusi, Paul Gerety, Chris Donovan, Joe Fortunato, Pat Fiorello, Vincent Mase, Brian Mahoney, Susan Crowley, Gary Zappelli (recently indicted by a grand jury for a false bomb threat, trial date August 15, 2014 in Woburn Superior Court,) quite a merry-go-round with Francis R. Pilleri, Jr. the sole individual maintaining control and power and throwing rocks at his accusers - Mase, Buccio-Notaro, Rumley and other ex-board members fled for their very lives.  The documents about the treatment of board member Doreen Wade are available via public records request. I have those documents.

Corporation dissolution?

Harvey Alberg's Air Freight Technology Inc., El Cheapos, Inc., Savant Technology, Inc., are all closed due to involuntary dissolution. Alberg's much-heralded Alberg Financial has this notice on the corporate website

Date of Involuntary Dissolution by Court Order or by the SOC:   06-18-2012

Medford Community Cablevision, Inc. is the only corporation not ended by involuntary dissolution.

That appears to be what the board of directors has planned for TV3,

Date of Involuntary Dissolution by Court Order or by the SOC:   05-31-2007Which is his prerogative, however, we are discussing a non-profit funded by cable TV subscriber monies with Medford Community Cablevision, Inc.

The Secretary of the Commonwealth disposes of corporations all the time, that's not the point.  The point is a PUBLICLY FUNDED corporation that believes it has zero accountability to the residents told City Hall it would voluntarily dissolve.  What if there is a benefit to the board of directors to INVOLUNTARILY DISSOLVE? that hurts the public which funded the entity?

The public has already been cheated out of access television for well over a year.  In reality, Frank Pilleri operated a private access station which benefited himself, according to Judge Jackson-Thompson's "private MCC access" information in her report.  So it can be safe to say Pilleri rarely offered "public" access, which was his mandate.

Ronald Delucia's Charitable Group Marketing Corporation has a

The three main board members of Medford Community Cablevision, Inc. all have had corporations dissolved involuntarily.  Again, if it is their own corporation, so be it.  But a NON-PROFIT that promised to have a VOLUNTARY DISSOLUTION not filing with the AG's office as of a few days ago, as I was informed by the Attorney General's office,  well, in light of all the unbelievable harassment and merry-go-round of board members, something very strange is going on, and the Mayor owes it to the cable TV subscribers to get to the bottom of it.

Komins Says League Owed Him Money

In an interview with Fox25 News, Stanley Komins denied accusations he stole money from the West Medford Hillside Little League. He said he spent “hundreds of dollars”, and was reimbursing himself for league expenses.
Komins and his son, Stephen, have been accused of stealing thousands of dollars from the little league, according to information released by the District Attorney Thursday.
Komins’ video interview with Fox25 is below:
