After careful consideration of all of the
evidence in this case, the papers submitted by all parties, and
the applicable law, this court concludes that an award of $25,000
of attorneys’ fees and $5,000 of expenses is appropriate. In
making this award, this court considered carefully all of the
equities, including the not insubstantial claims asserted by Mr.
Cliggott against Mr. McMahon and Mr. Zamparelli with respect to liability for partnership by estoppel as to the alleged
negligence of Mr. Glionna.
