RE: January 28, 2016 Correspondence

Dear Public Charities Division:

I thank you for your prompt response to my January 26, 2016 Public Records Request.  I am carefully reading 950 CMR 32.08 to follow the proper procedures to appeal.    

Your blanket statement that every item - every document - that I have requested is not "subject to disclosure" as (in one instance) " (f) ...of effective law enforcement that such disclosure would not be in the public interest."

I can assure you, it IS in the public interest as the public funds public access and the failure of the public charities division to efficiently prosecute alleged offenders resulted in Maura Healey's chosen candidate having the upper hand.  You see the conflict of interest for the Attorney General's office -
Maura Healey endorsed Stephanie Muccini-Burke - a poor speaker, inarticulate, and not as sharp as
her opponent, the 36-38 year veteran city councilor, Robert M. Penta.

Mrs. Burke and her benefactor, Michael J. McGlynn, maliciously squelched free speech as it benefited them and was NOT in the public interest. 

Crowds flocked to Mr. Penta's speeches, 10 people were said to have shown up to Mrs. Burke's cake and ice cream at the Medford Housing Authority where the new mayor has stashed her own mother (rather than letting her own flesh and blood reside at the Burke family's second address in Blackstone."
If a mayor treats her own mother with such contempt what can the citizens expect? But I digress...the fact that I'm writing this letter (again) shows the unfairness of the Attorney General's office not making a priority of the alleged missing monies at Medford Community Cablevision, Inc.

You can understand the frustration of the Medford citizens when:

a)About Four Hundred Thousand dollars or more of cable TV subscriber monies are languishing in a bank vault

b)Tonight, 1/30/16, on or about 7:30 pm, the new Mayor, Stephanie Muccini-Burke, had a poorly recorded inauguration tape airing.  The new mayor, ENDORSED BY Attorney General Maura Healey, was utilizing the access TV she is denying the residents, just as her predecessor did.

c)the lack of access TV benefited Mayor Stephanie Muccini-Burke and, by association, Mark Rumley, the city solicitor who promised the citizens he would deliver Medford Community Cablevision, Inc.'s financial records in ten days, and - 18 months later - has been derelict in his duties and obligations.

Their failure to do the people's business, their abuse of the system, enabled them to deceive the public and put any opponent challenging Mayor McGlynn's 'heir apparent" at a distinct disadvantage

This benefited the "public servants," the city officials, who served themselves and cheated the residents.

Your blanked statement that ALL documents are exempt from disclosure because of "law enforcement" is a slap in the face to the cable TV subscribers.  But of course, Attorney General Maura Healey endorsed the woman, Stephanie Muccini-Burke, who benefited from such a lack of transparency.

I kindly, and respectfully, request that you prosecute the board of directors of Medford Community Cablevision, Inc. and find out why Thirty Eight Thousand Dollars seems to be missing in action.

As a former member in good standing at MCC (I resigned; they will tell you they threw me out - they are pathological liars who write up phony meeting minutes and separate them into two separate and simultaneously issued documents - which, of course, I can show you,) when they document meeting minutes at all!) I, and many other former members, want to know where the money went.

Beyond City Solicitor Mark Rumley keeping his job when it was obvious with the real mayor, Bob Penta, duly elected, Rumley would have been fired, we know why free speech was squelched in the city of Medford.

“The one sentiment that I have heard that I take great exception to is that the city is trying to limit speech,” said Rumley. “The notion the city would censor or squelch free speech is baseless and as city solicitor I would find any such effort repugnant.”

According to the AG’s website, MCC President Frank Pilleri submitted a petition for MCC’s dissolution June 18. In his letter, Pilleri said MCC had distributed all its assets to the city.
The petition also included a financial review by David M. Jacobson, a Salem-based CPA, indicating MCC had no remaining assets or liabilities.
City Solicitor Mark Rumley said the city took possession of equipment from TV3’s former office at 32 Riverside Ave. in January. But Rumley said the city has not received any money from MCC, nor does it know how much money, if any, the organization still has.

On July 7, Rumley sent Pilleri a letter requesting financial data from MCC and information about where it transferred remaining assets. Rumley asked to receive the records by July 24. (2014)
Rumley had not received records from MCC as of the Transcript’s Tuesday print deadline.


So  it has been 7 1/2 years in which Solicitor Rumley yelled from the rooftops that he is Mr. First Amendment, almost 18 months since the suspicious board of directors filed for a dissolution which has yet to be granted (thank God.  Not until they are held accountable in a court of law,) and eighteen months and six days since Mark Rumley got on his high horse and said he would have the financial records in ten days.  
THE NEXT PARAGRAPH CENSORED FROM PUBLICATION AS IT INVOLVES
A SEPARATE ISSUE ABOUT TV3 AND PORNOGRAPHY, ALREADY REPORTED TO THE FBI, OFFICE OF THE DISTRICT ATTORNEY, THE POLICE AND NOW THE A.G.

Far from it.

I respectfully disagree with the flawed response to my request for public documents.

The failure to respond properly certainly benefits Maura Healey's chosen candidate and her cronies, but I can assure you, Public Charities Division, it does NOT serve the best interest of the public paying for a service that city hall is deliberately withholding.
To quote Bruce Willis as Detective Lieutenant John McClane "Would you like to go for Double Jeopardy where the scores can really change?"

Please be more forthright with the residents of Medford.  We deserve it, and the Attorney General is highly conflicted when it comes to Stephanie Muccini Burke and the public access TV station that, currently, does not exist.
