Dear Mr. Hurtubise,

As Attorney Kim Scanlon can advise you, I have been asking for documents regarding wooden benches that disappeared from Medford city hall circa 2000 or 2001.

I am cc:ing  the Public Records Division of the Secretary of the Commonwealth in this correspondence

In regards to the documents regarding the city hall doors, the oak benches and the curbstones at Ring Road here is some information:

1)The first response that I received from Mr. Rumley's law office was ridiculous claiming "no documents" and that the residents own the material or some such nonsense - see the 3 attachments dated March 28, 2019 in response
to my March 15th public records request - which follows my signature below.

2)I do not want to write a third appeal at the moment,  though I will further appeal the response, if need be, and file a new appeal to assess any issue within the scope of the Public Records Law.
 
Mr. Hurtubise you have been very professional and have gained my respect,
as has Attorney Scanlon and Janice Spencer.  It is refreshing when public servants actually serve the public.

That Medford has had so many issues, from questions about voting machines to suspicions about your predecessor, questions about missing copper at Medford Housing, allegations of manhole covers missing at the DPW, Mr. Rumley spending too much energy limiting speech in Medford, oak benches walking away from Alden Chambers, Ed Finn leaving trash outside of Alden Chambers for months and months, and blaming a non-employee (Judy Lonergan) for his failure to perform (see photo) - and if citizens ask questions they can find a phony criminal complaint filed by an under-performing councilor, Rick Caraviello, who should have been removed from the council the moment that he lied to the police to push fraudulent charges in criminal court to attempt to silence a reporter.

Everything that Finn touched, everything that Caraviello, Dello Russo and his apology, Mr. Rumley and Adam Knight touch, it is all the "fruit of the poisonous tree."  These individuals are toxic to life in Medford.  We have chronicled their underhanded tactics over the years and we know what they are all about.

That being said, I would like the response that city hall gave to Bob Maiocco when he requested in 2001 where the oak benches from city hall went. 

That city hall said they had no documents, then - after my appeal - documents appeared out of nowhere, is proof that Mr. Rumley does not take his oath of office seriously.  He's a bully; a petty little man with a big mouth - talking over Michael Marks with no respect for the podium, no respect for the residents, no respect for the council rules.  16 years of my life, since 2003, have been spent working to make Medford a better place to live.

The question is: where are the documents responding to councilor Maiocco's valid concerns about the oak benches, the wooden benches, which were comfortable, valuable and historic?

That city hall didn't want to answer the question speaks volumes.

I respectfully request that we - as a city - you, as city clerk - find these documents.

My investigation into the Chapter 74 board and its failure to abide by the Open Meeting Law is all you need to know.  The money that I personally saved the city by forcing the shut down of Medford Community Cablevision, Inc. went right out the back door when Mayor Muccini-Burke and Superintendent Roy E. Belson hid the Chapter 74 board from both the school committee and the city council.

Why does an investigative reporter have to be the sole person to uncover that kind of underhanded, deceptive business practice employed by this lazy mayor, this mayor with a group of questionable and highly suspicious "government officials" working with her to the detriment of the city and the citizens of this city.

Missing copper, missing manhole covers, missing benches, missing doors, missing access television, ex-Chief Leo Sacco's son not getting a breathalyzer, former officer Stephen Lebert making a death threat, the sins of Medford City Hall pile up at an exponential rate.

So let's focus right now on the missing wooden benches.  Is there a response to Mr. Maiocco's motion or resolution to find out where the benches walked off to?

RE: Public Records: City Hall Former Doors, Alden Chambers Wooden Chairs, curbstones from Ring Road


Dear Ms. Scanlon and/or Keeper of the Records:


This is a request under the Massachusetts Public Records Law (M. G. L. Chapter 66, Section 10).

I am requesting that I be provided a copy of the following records:

1)all documents at city hall or any other area where Medford's city government and other agencies keep records, documents being notes, e mails, and other documents, regarding the removal of Medford property - specifically, documents describing or discussing the property owned by the citizens of Medford and what happened to the property owned by the citizens of Medford

a)Curbstones from the construction work on Ring Road

b)wooden seats in Alden Chambers 85 Geo. P. Hassett Drive, the wooden seating replaced by cheap, uncomfortable plastic chairs

c)the three doors at the entrance of city hall

2)documents detailing the amount of property referenced above

3)documents detailing the dollar value of the items noted above

4)documents detailing which person(s) or company (companies) are in possession of those items and what they paid for them, if anything

I recognize that you may charge reasonable costs for copies, as well as for personnel time needed to comply with this request. If you expect costs to exceed $10.00, please provide a detailed fee estimate, however as a journalist in this city I request that you waive the fee as this matter is of great public interest.

The Public Records Law requires you to provide me with a written response within 10 calendar days. If you cannot comply with my request, you are statutorily required to provide an explanation in writing.
