RE: Election 2017; Ed Finn's involvement unfair to this mayoral candidate
Dear Attorney Rumley,
Rick
Caraviello's behavior at the City Council in regards to the public
speaking freely has been problematic. On or about March 28 2017 Mr.
Caraviello ILLEGALLY phoned the police prior to a council meeeting after
he ordered me to stand near the window to videotape, and only after I
complied with his demand.
Caraviello
seems to have muttered "I'm calling them (the police) anyway." I was
not allowed to participate in the public debate simply because Mr.
Caraviello lost a criminal complaint that was based on false charges.
Mr.
Caraviello, along with retaliating, I believe violated his oath of
office regarding the United States Constitution and it's First
Amendment.
The following oath of office is one that is commonly used:
I,
_____, do solemnly swear [or affirm] that I will support the
Constitution of the United States and the Constitution and laws of the
State of Washington, and all local ordinances, and that I will
faithfully and impartially perform and discharge the duties of the
office of _____, according to the law and the best of my ability.
At
trial on 1/31/17 Caraviello admitted under oath. that the city clerk
was involved in a "yelling" incident. The moment Mr. Caraviello's lips
put that on the public record, there should have been an investigation
into the activities of Edward P. Finn.
Since
you, Mr. Rumley, have stated to a retired judge your alleged love and
passion for the First Amendment, why have you not investigated both Mr.
Finn and Mr. Caraviello for their dereliction of duty and their
censorship practices? Mr. Finn, as you know, told his staff not to
allow me to file petitions with the council until he returned from
vacation.
Not allegedly. His staff told me this when I attempted to file a petition.
As
I am running for mayor, I demand that Edward P. Finn be removed from
any involvement in this important election. If you do not see the
importance of this, that Clerk Finn has a vendetta against this
candidate, has censored this candidate's petitions to the city council
in the past, then I respectfully ask that you step down as City
Solicitor until the end of the election.
Please see Exhibit A:

Senate Republicans back off proposed restrictions on media

Senate
Republicans on Tuesday quickly backed away from a proposal to restrict
media access in the Capitol after an angry backlash from reporters and
an emergency meeting between the Senate Rules Committee and the media
gallery directors.
Senate
Rules Committee Chairman Richard Shelby (R-Ala.) sent out a statement
around lunchtime clarifying that there would not be a rules change, only
a discussion about how to ensure safety as the Capitol hallways have
become more hectic because of growing crowds of journalists.

Mr. Caraviello doesn't understand our free speech rights.
There are serious concerns regarding this Administration and the First Amendment to the U.S. Constitution.
Mr.
Caraviello stated, under oath, that the city clerk was involved in a
"yelling incident." Since I didn't say a word when Finn had a meltdown -
the best euphemism I can find for Finn's yelling and more, it was
clearly Mr. Finn doing the screaming in the place where he works, where
he is supposed to SERVE the public, not harass them.
The
fact that Caraviello admitted Finn was involved in not serving the
public with the yelling, and that it is on court record, gives great
weight to my request.
When
I went to city hall on or about June 16, 2015, it was to talk to the
videographer. Mr. Finn interfered in my conversation, I was not
addressing Finn - he was eavesdropping! No matter what legal mumbo jumbo
you may want to call it two years later, eavesdropping on a
conversation that did not concern him was unethical for a public
servant. Indeed, Finn blurted out "Richie votes for Penta" which is
outrageous, a city clerk telling a resident who a city employee votes
for. How is this public service? That's not in Finn's job description -
and that's the problem.
Mr. Finn creates his own rules, rules which are the antithesis of public service.
Equally
outrageous is the allegation from a former Republican State Committee
person that Mr. Finn's wife - and possibly Finn himself - allegedly in
June of 2015 told the committee person, Robert Cappucci - that Penta
would "lose" the election and that Finn's candidate, Stephanie Burke,
would win.
This is unprecedented, if true.
Do
you realize how serious this is, Mr. Rumley? Of course you do. After
fifteen years of watching very disturbing behavior by government
officials in Medford who think their fantasy of the law is actually the
law, it is time for fresh eyes on Medford government. That's why I am
running for mayor, and that's why Mr. Finn is not capable of being part
of the primary process.
City
Hall failing to address this issue with Mr. Finn's bullying "yelling"
and eavesdropping, as well as the alleged proclamation on who would win
election 2015, are reasons why the primary will be suspect if it has the
involvement of Edward P. Finn.
I await your response.
Sincerely,
Joe Viglione
