RE: Facebook Live City Council from 7-8 pm
Dear Council Vice President Michael Marks:
Tonight I have requested to go "Facebook Live" from the reporter's desk as:
a)it is probably the best angle for my thousands of readers
b)it won't be in the way of speakers at the podium
Because
certain councilors (Adam Knight, Fred Dello Russo, former councilor
Paul Camuso) have slammed doors, shuffled papers, acted in a juvenile
fashion on speakers like Robert M. Penta, Jeanne Martin and others, it
is clear to me that the juvenile antics of Knight, Dello Russo and
Council President Richard F. Caraviello may come in to play again.
These unseemly and vulgar activities violate Rule 9 of the city council's rules:
http://www.medfordma.org/city-council-2/city-council-rules/
Duties of the Presiding Officer
Duties of the Presiding Officer
Rule 9.
The
presiding officer shall preserve decorum and order, and shall decide
all questions of order, subject to an appeal by the City Council,
regularly seconded; and no other business shall be in order until the
question on the appeal from the ruling of the Chair shall be by roll
call and shall stand, unless a majority of the votes are to the question
of appeal.

As
Council VP I expect you to maintain some order and some sense of the
decorum expected by our council rules, though there is taped evidence
that it is extremely difficult for those three councilors to behave in
an adult manner.
I
am not exhibiting humor here, I am quite serious. Mr. Camuso's
childish antics are a matter of public record. Knight, Dello Russo and
Caraviello seem to want to continue the abusive practices that possibly
led to Camuso choosing to step down from the council.
Richard
F. Caraviello, after losing in criminal court on January 31, 2017,
retaliated against this reporter last week, March 21, 2017, when he
violated Robert's Rules of Order for Roy Belson yet shut all speech down
to slap this journalist in the face, in violation of Rule 36,
Parliamentary Practice.
Parliamentary Practice Rule 36.
In
all matters of parliamentary practice not provided for in these rules,
the City Council shall be governed by Robert’s Rules of Order.

My goal is quite simple: disseminating information to the public.
Richard F. Caraviello in January of 2016 and the city solicitor were
hovering around three police officers - allegedly attempting to keep me
away from the city council. I spoke to Officer John Ghilain and
explained to him that Judge Fitzpatrick (and later Justice Wexler) gave
me permission to speak at the council despite Caraviello's horrific
attempt to squelch free speech by engaging in malicious prosecution.
That will be dealt with in Federal Court as I am suing Caraviello, the
city, the Medford Police Department, the office of D.A. Marian Ryan and
possibly others in Federal court soon, as well as a filing - possibly
this week - with the Mass. Commission Against Discrimination for
"retaliation" and other possible charges.
Note Rule 43
Council Chambers
Rule 43.
The
Medford City Council Chambers shall be open to all Medford citizens for
the purposes of disseminating public information, holding of public
meetings and hearings, the holding of City Council and School Committee
meetings when called, and all festive activities relating to the working
of the City Government At no time within the Council Chambers will
banners, placards, hand held signs or any other public display of
advertising an issue before the City Council be permitted. Edward P.
Finn, City Clerk printed this edition on October 16, 2007

My credentials are vast and cannot be argued with. http://joeviglione.com/
(DELETED FROM THIS BLOG, available in letters to the council)
My opinion is that when we have documentation that an Adam Knight, Fred Dello Russo Jr. and a
Richard
Caraviello have not substantially contributed to our council, that when
they don't meet requirements we should have in place for the $30,000.00
they voted themselves to have without any input
from the citizens of Medford (we can discuss the suspicions about the
election another day,) they should be removed to allow a Neil Osborne,
Chris Daveta or Mark Crowley (all in the BCC) to take their place.
Knowing all three gentlemen, I believe they would never behave in the
same atrocious fashion as Dello Russo, Jr., Knight and Caraviello. One could bet on it.

1)Enclosed is my business certificate dated June 5, 2015, Medford Information Central.
As you are aware, under oath in a court of law Council President Richard F. Caraviello stated that
the clerk who issued my online magazine's business certificate, Edward
P. Finn, was involved in a "yelling" incident (11 days after I purchased
the magazine's business certificate) where he did all the yelling (and
the physical abuse of a senior citizen with his vulgar and painful
"chest bump") with the frosting on the cake, Finn yelling "Get A Job"
after I politely asked him in Alden chambers to do his job.
2)I'm
writing to you because Paul A. Camuso and Adam Knight slandered me (and
once cablecast, it became libel as well,) saying "Where's your Boston
Press Pass."
a)Last time I looked, the signs on the borders declare "City of Medford"
b)Do I need to wear my metal David Bowie Diamond Dog medallion from the 1980s? The press pass I was able to obtain for John Byers to
interview executives from the Red Sox and Bruins (as well as my own,) or
the daily press passes I receive (about 4 or 5 a day) to attend film
premieres?????

Engaging in "news gathering" since 1969,
as a professional journalist published in multiple books (see http://joeviglione.com
,) having interviewed over 1,000 personalities including but not
limited to Doors' members Robbie Krieger, Ray Manzarek, John Densmore
and their engineer/producer Bruce Botnick (I did speak with original
Doors/Janis Joplin producer Paul A. Rothchild while I was in L.A. with
the Rolling Stones producer, Jimmy Miller, but - sadly - Rothchild died
at 60 in 1995 when I started my new show, Visual Radio, now 22 years
old,) Gilbert Gottfried, Jodie Foster, her director Robert Zemeckis,
Michael Moore,
Mick
Taylor of the Rolling Stones ...etc. etc. etc. it is absurd that
unqualified hacks who sit on our council want to besmirch, smear and
attack any citizen that they disagree with, be it a Bob Cappucci or a
Cheryl Rodriguez. The fact that I actually have credentials drives them
out of their minds.
That
being said - if their amateur perspective is that my six decades of
writing is not enough to satisfy them, my award-winning radio and
award-winning tv show, taping tomorrow 1 PM - 3 PM in Somerville, is
proof enough according U.S. District Court Judge Michael Ponsor, even a
public access TV host has the same rights as a "professional."
How
telling that the attorney for the losing side is the attorney Medford
employs, Peter Epstein, who should know better! (see exhibits below)
That
being said, Councilor Marks, if there is plain and expected stupidity
from Adam Knight, Richard F. Caraviello and Frederick N. Dello Russo Jr.
(a disgrace to the Dello Russo name) - it will give great weight to my
court case against the city.
See you at the council tonight. I will have my Tripod and
my Facebook live and desire to place them on the reporter's table, as I have requested of you in advance.
Thank you.

Last week, however, U.S. District Judge Michael Ponsor in Springfield ruled that such shows constitute a "public forum" and have First Amendment protection.
Federal Judge Rules 'Amateur' Journalists Have Same Rights As Pros
... that nonprofessional news gatherers have the same rights as professionals, ... It is the first ruling of its kind, said the American Civil Liberties Union, which represented plaintiff Patricia Demarest in her fight with Athol/Orange ... The judge essentially agreed, writing that the requirement "made news makers news editors .

A federal court ruled that several rules of a Massachusetts public access channel unnecessarily restricted free speech rights and interfered with the newsgathering ability of two people who used the public access channel.
A
federal judge on Feb. 28 granted two producers of a public access
television show aired in Athol, Mass., a preliminary injunction against
the cable television station, which had barred them from production for
breaking three of its rules.
The court said application of those rules violated the First and 14th amendments to the U.S. Constitution.
The
court's decision "opens up more doors to the common citizen to be
granted the same rights as a professional journalist," said Patricia
Demarest, a plaintiff in the case and co-producer of "Think Tank 2000."
Demarest's
attorney, Bill Newman of the American Civil Liberties Union, agreed,
saying the ruling "empowers citizens as publishers to gather
information."
Demarest
said she began "Think Tank 2000" to inform and involve Athol's citizens
in local politics by giving them the "whole picture" on a wide range of
issues.
